1. GENERAL PROVISIONS

 1.1.            Compulsory Regulations (hereinafter "CR") for Odessa sea commercial port have been issued in accordance with Article 78 of the Code of Merchant Shipping of Ukraine.

1.2.            The CR are applicable to the vessels flying all flags and subject to all authorities staying within the port as well as to organizations, enterprises, institutions and persons that pursue their activities within the territory and port water area of the port. References to ignorance of provisions of the General Rules and CR do not discharge from liability for their violation. In case of differences between the General Rules and these CR, the provisions of the latter prevail.

1.3.            These CR will make the CR issued in 2004 null and void.

1.4.            All the interested persons can become acquainted with these CR on the webpage of the Odessa port www.port.odessa.ua in the section “Normative documentations”.

1.5.            With the aim of ranking the berths of the port, in accordance with the order of the Harbor Master the following berths shall be numbered:

            The numbers of berths will be mentioned hereunder in accordance with the abovementioned table (the old numbers of the berths will be mentioned in the brackets).

 1.6.            The border of the Odessa port from the land is located within the artificial barrier, which separate the port territory from the city lands and territories of adjoining organizations, in the agreed borders and passes through

 In the south district:

-         by the fence from the water edge at the root of the quarantine pier around the TIR parking till the west sides of the buildings of Odessa Ship Repairing Yard (OSRY) No 2, then till the slopes of T.G. Shevchenko Park, along the precipices of the Park and civil buildings till the Customs Square. From the Customs Square by the sides of the administration buildings of the port and the entrances by the stone fence along the Prymorskaya Str., including entrances to the overpass to the passenger terminal, to the square before the Voeniy Descent – entrance of overpass. Along the metal fence of the west end of the Staroslyanaya ramp and by the normal through the railways of the even mouth of Station Park till the enclosure of the footway with the turn to the fouling point indicator of the railway of berth 26. From the fouling point indicator by the edge of the building of accumulator building and by the fence till the railway passage of the Armyanskiy Lane., then by the west metal enclosure till the enclosure of the military unit up to the edge of Androsov pier and the berth 28.

 In the north district:

-         from the water edge of the Androsov pier along the fence and the buildings, separating the territory of the military unit at the Androsov pier, till the entrance at the Geft Str., then by the fence along the Geft Str. till the enclosure, separating the entrance to the internal yard of the administration of the plant, then along the fence of administration of the plant and along the railways of the Gas Park till the entrance to the Khlebnaya Harbor. From the entrance to the Khlebnaya Harbor by the fence, separating the port from the port’s elevator, Sugar company, Export-Import of Oil Products, till the crossroad with the Petrenko Str., then along the entrance of the oil district and by the fence along the channel of Odessa Heat Station.

 In the passenger terminal district

- The territory of the passenger terminal – berths No 15-20, pontoons of the yacht complex, which is limited by the metal fence from the edge of the berths No 14 and 15 till the edge of the berths 20 and 21, overpass with two entrances to the Primorskaya Str., is not regarded as regime area. During the control of the vesels by the border and Customs authorities, additional regimes will be established.

 1.7.            The port water area includes the inner water areas of the port and the passing channel, as well as, the water area of the central authorities of the executive authorities.

            The inner water area of the port includes the water space, limited by the points, which connect the external hydro-technical equipment of the port.

            The inner water area of the port includes the water space, limited by the points, which connect the external hydro-technical equipment of the port. The water area, which belongs to the naval base of the naval forces of the military forces of Ukraine (hereunder called as naval base) and the detached forces of maritime security of the State Border Service of Ukraine (hereunder called as detached forces of maritime security) (see attachment No 5), is excluded from the inner water area of the port. This water area is limited by:

  • Part of the water area of the Practical Harbor, which consists of water space, limited by the berths No 29(34-B), No 30 (35-B), No 32 (37-B) and the line, passing from the south-east edge of the berth No 32 (37-B) of the Potap Pier through the point, going to the deep part of the Practical Harbor by the line of the edge of the Potap Pier at the distance of 90 meters, and then to the edge of adjoining of berths No 287 and 29 (No 34-B).
  • Line of water space, which width is 40 meters, along the berths No 34 (39-B) and No 33 (38-B) of the Potap Pier and line, which width is 10 meters along the edge of the Potap Pier.

In general, the water area of the Practical Harbor is regarded as the inner water area of the abovementioned authorities concerning the organization of the regime of navigation and fulfillment of special measures concerning the protection of the berth for the vessels and provisions ships. The stoppage of the vessels of civil authorities at the abovementioned places do not free their owners and crew from the irresponsibility for the fulfillment of all requirements of these CR.

The vessels will be anchoring at the anchorage No 355, after receiving the permission of the Inspection of State Port Supervision, by the order of the pilot-operator of the Service for Regulation of Vessels Navigation (PRVN). The vessel will be anchoring at the anchorage with the aim of fulfilling the assistance operations, registration of the vessels, receiving bunkers, water, provision, simple repair, etc.

The anchorage No 354 is intended for the big-tonnage vessels, as well as, for the tankers and vessels with dangerous cargo. The borders of the anchorages are established in the maps.

 

1.8.   The port station of the Odessa port is located at the "Zmeiniy" island, which has its own berth complex. This berth complex includes two berths, cargo berth and assistant berth. The construction of the cargo berth allows to fulfill the mooring of the two types of vessels with 8000 tons and 3000 tons displacement, draught 6.5 m. The length of the berths, the depths and the permissible draught near the berths are mentioned in the order of the Harbor Master.

Each vessel, which is planning to enter to the port station "Zmeiniy" shall, by the means of phone (fax) or e-mail connection, inform about the planned arrival and the aims of navigation, mentioning the dimensions of the vessel, planned operations at the berths of the complex (wait stoppage, cargo works, passenger operations), time of mooring, time of fulfillment of operations of works, quantity of cargos and passengers, etc.

1.9.            The declared draught at the berths is calculated taking into consideration the depth near the berths up to 3 meters from the cordons. The draught is calculated without taking the run-up/set-down of the water in the port into the consideration. The declared draught is announced by the order of the Harbor Master and informed to all, whom it may concern. The sailing draught in the port is calculated in each individual case depending on the type of the operations, which will be fulfilled (loading or discharge) and the present navigational conditions. The sailing draught is calculated by the Inspection for State Port Supervision (ISPS) and the Master of the ship.

 

1.10.        The Radio-location post for the regulation of the vessels' navigation (PRVN) and the pilot service are located in the Odessa port. These services are members of State Enterprise "Delta-Pilot". The PRVN fulfills the regulation of navigation and control of safety of navigation of all vessels and floating-means, which are located in the port's water area and in the zone of control of PRVN. The pilot steering is fulfilled by the by the means of state pilots (hereunder called as pilot). The pilot steering and the services for regulation of vessels' navigation, as for the vessels, which are arriving to the port, or for the transit vessels, is fulfilled in accordance with the applications, presented by the agent or the vessel in-time to the PRVN Odessa. The dues will be charged for the offered services in accordance with the established rates.

 

1.11.        The pilot steering from the place of embarkation or to the place of disembarkation of the pilot, which is located at the angel 90° from the Vorontsovskiy lighthouse and at the distance in 2 miles, is regarded as out-port steering. The pilot steering inside the water area of the port is regarded as in-port steering.

 

1.12.        The vessels, which enter the port, independent of belonging and flag, shall correspond to the rules of the International Martine Conventions, concerning their type, accepted by Ukraine and shall correspond to the safety requirements of the port, environment, human and vessel safety. The absence of the evidences of the abovementioned or discovering of violations may cause the delay of the ship or payment of the penalty. The control of the vessel concerning the examination of the ability of the vessel for navigation and fulfillment of the rules for protection of the environment shall be organized by the Harbor Master Service, in accordance with the Code of Trade Navigation (CTN) of Ukraine and the "Provisions concerning the Master of the Ukrainian Harbors".

 

            The Harbor Master has the right to forbid the exploitation of the vessel, which can cause the danger to the navigation and environment, until all these violations will be eliminated.

 

1.13.        The territory and the inner water area of the port, in its established borders, is the regime area, which is protected by the Maritime Security Service and the divisions of State Border Service.

1.14.        Except the CR, all the vessels shall fulfill all the requirements of the "General Rules of Marine and Fishing Ports" (hereunder called as General Rules).

1.15.        Violation of the requirements of CR and General Rules may bring the charging of penalty.

 
2. ENTRY OF VESSELS TO THE PORT AND DEPARTURE FROM THE PORT

2.1.   
ARRIVAL OF VESSELS TO PORT

 Registration of arrival

2.1.1.      Entry to the Port is allowed round-the-clock.

2.1.2.      Arrival of vessels is registered in the posts of the Inspection for Port Supervision of the Administration of the Harbor Master (hereunder called as AHM), which are located at the:

 

  • Central post of the Inspection for State Port Supervision - at the territory of the port at the Devolanovskaya Str. in the building of the Administration of the port No3 at the 4th floor, phone: 729-44-22 and 1-20-66;
  • Post of the Inspection for State Port Supervision in the passenger terminal - in the building of passenger terminal, phone: 1-20-84;
  • Post of the Inspection for State Port Supervision in the oil harbor - in the building of administration of oil district, phone: 1-20-96;

 

            If it will be required, the registration of arrival of the vessels, which are anchoring at the anchorage No 354 and No 355, shall be executed by the marine agents in the central post of the Inspection for State Port Supervision. The certification of the registry of vessel's journals and issuance of references for the formation of the marine protest is executed in the central post of the Inspection for State Port Supervision. The vessel’s, machine and other journals are certified at the posts of the Inspection for State Port Supervision in the port (central, passenger terminal, oil harbor).

 2.2  DEPARTURE OF VESSELS FROM THE PORT

Preparation for departure

2.2.1.      Departure of vessels from the Port is carried out round-the-clock.

2.2.2.      The correspondence of the vessel to the requirements of the International Conventions, Codes, national rules and other normative documents, concerning the safety of navigation, protection of human life at the sea and prevention of pollution of environment, shall be examined by the ISPS, as a rule, 2-3 days before the departure of the vessel from the port. The results of the examination shall be formed as acts of "A" and "B" form.

            The readiness of the vessel for departure is examined by the ISPS after finishing of freight operations and fixation of the cargo, after that the departure of the vessel will be registered.

2.2.3.    The Masters of the Ukrainian vessels, going to outward voyage, and the
Masters of the foreign vessels, through their agent companies, shall inform
the ISPS about the readiness of the vessel for departure not less than 2 hours
before the work of the border and customs control on the vessel.

            If the Master will reject to moor/sail/re-moor after the application about the readiness of the vessel was delivered, the pilot and tugboats, presented for the fulfillment of the abovementioned operations, can be recalled. In this case, the application for the pilot and tugboats should be presented again. The responsible persons for the vessel shall pay, in this case, the pilot rate and the time of actual working of tugboats in accordance with the established rates.

2.2.4.      The permit for departure of a repaired vessel after docking at the ISRY can be issued in 6 hours after launching.

2.2.5.      No vessel has the right to leave the Port without registration of the departure by the Port Supervision Authority.

Registration of departure

2.2.6.      Departure of the vessels is registered at the posts of ISPS by the Masters of the vessels or marine agents.

2.2.7.      Departure of auxiliary vessels, small port craft as well as passenger coastal boats sailing within the zone of control of PRVN are registered with the ISPS during the term up to 15 days. During this time, each arrival or departure during the sailing in this area shall be agreed with the ISPS and formed by channel 9.

2.2.8.      The permission for the departure of vessels, registered their departure, is issued by the PRVN in accordance with the VHF after agreeing with ISPS.

2.2.9.      Masters of vessels arriving to the Port for loading any cargoes or for partial loading / discharging of grain, loose and bulk cargoes must, before beginning of freight operations, submit to Port Supervision Service the Declaration on transportation properties of cargoes, the cargo plan (by termination of loading or partial discharging of a vessel) which corresponds to one of variants of loading in accordance with the Master's information about stability of the vessel when carrying grain or bulk cargoes. The information about the vessel's stability should be certified (signature and seal) by the Register or a foreign classification society.

            If a vessel carrying grain and/or loose and bulk cargoes has no information about stability or if such information has not been certified by the appropriate classification society, its departure may be permitted after drawing up the cargo plan together with the Register that should make an appropriate comments on it.

2.2.10.                          Before a vessel sails to sea, her administration has to submit to the ISPS the calculation of vessel's stability and the static stability diagram showing the corrected and permitted metacentric heights.

2.2.11.                          The services rendered by the ISPS in connection with registration of arrivals and departures of vessels and checks of their conformity to International Conventions are paid according to the effective Port rate.

2.3. GENERAL PROCEDURE OF ENTRY AND DEPARTURE OF VESSELS TO/FROM THE PORT

2.3.1.      Masters of all vessels navigating in the Port waters must strictly fulfill the requirements of these Compulsory Regulations.

2.3.2.      The entry and departure of vessels to/from the port is fulfilled through:

 

-         East entrance

-         West entrance

-         North entrance

-         Pass-through channel, which consists of first and second sweeps of the channel (width of the first sweep is 100 m, second - 150 m; depth of the channel is 14 m).

-         During the stop of gas carrier at the berth No 7h, the navigation of all types of floating craft through the North entrance is prohibited.

 

 

2.3.3.      The pilot steering of the vessels in the Odessa Sea Commercial Port is obligatory. The entrance and departure to/from the port and the re-mooring in the port is fulfilled round-the clock only under the steering of pilot. The vessels of the port, Ukrainian vessels, Masters of which have the permission of the Captain of the port for the navigation without pilot, vessels and ships of Armed forces of Ukraine and Maritime Security of the State Border Service of Ukraine, are excluded from the above-mentioned rule.

 

2.3.4.      he Master of a vessel (agent) orders a pilot and tugboats (for shifting or departure of a vessel to sea) after registration of the departure with the ISPS or during the re-mooring via the Pilot Service operator 45 minutes before the vessels is completely ready for mooring ("Odessa-Radio-2" channel 22, tel. 1-20-30, 725-29-33, 729-44-95). The Master of a vessel (agent) shall confirm the readiness of the vessel for departure 30 minutes before the departure of the vessel via PRVN pilot-operator ("Odessa-Port-Control" channel 14, tel. 1-37-30).

 

2.3.5.      For the ships, arriving from the sea to the berth, the point of meeting of pilot is the direction 90° in 2 miles from the Vorontsov lighthouse. If the weather conditions are not good, the place of meeting can be changed by the agreement with the Master of the ship, PRVN pilot-operator and the Master of the floating craft, which is servicing the pilot. The pilot will be brought to the vessel and taken from the vessel by using different floating craft in accordance with the weather conditions.

Masters of Ukrainian vessels regularly calling at Odessa Port may be permitted to enter and leave the Port independently by the Captain of the port under the agreement with the State Enterprise "Delta-Pilot", however the right of independent navigation within port waters does not relieve vessels from paying the pilotage dues.

2.3.6.      When approaching such vessels the navigators of all other vessels shall be very careful

2.3.7.    To obtain the right of independent navigation in port waters, the navigators (Masters, chief mates, and navigators) of auxiliary vessels, small craft and port fleet passenger boats are obliged to submit to the Captain of the port the Protocol of annual knowledge test of COLREG-72, Compulsory regulations, general rules, navigation area and its means of enclosure, and the vessel technical data test.

In case of rough infringements of COLREG-72, General Rules and these CR, a navigator can be deprived of his right of independent navigation in Port waters.

2.3.8.      If the navigational, meteohydrographical situation in Port waters change, Masters of all vessels, except for passenger boats, hydrofoil vessels and small craft, are obliged to take, irrespective of independent navigation, a pilot on board.

2.3.9.      Mooring vessels, which main engine, steering or anchor arrangements are out of order, is possible with the permit of ISPS only. In this case the services of the pilot and linesmen are paid double.

2.3.10. Before the arrival of the vessel to the port and its departure from the port, the Master of the vessel shall take sure that there are no outsiders on the board of the vessel and shall inform the border authorities about that.

3. NAVIGATION OF VESSELS IN PORT WATERS 3.1. NAVIGATION CONDITIONS

General provisions

3.1.1.      Control of the movement of vessels and floating craft in port waters is fulfilled by the Post of the Regulation of Vessels' Navigation of the State enteiprise "Delta-Lotsman" (hereunder called as PRVN).

3.1.2.      The vessels, going to moor to the berths of the port, shall keep their anchors in jacks, but the anchors shall be ready for the immediate dropping in the critical situation.

3.1.3.      All the vessels, which are moving or moored to the berth, are prohibited to drop the following outside the board: jibs, cranes, front access lader, boats and other equipment without agreement with ISPS. The pilot ladders are permitted to be dropped outside the board only during the embarkation and disembarkation of the pilot.

3.1.4.      A vessel carrying explosive and flammable cargoes is obliged to anchor in anchorage No.351 to wait for the orders of the Administration of the port. The above mentioned vessels, when staying in Port waters, are obliged to raise to a conspicuous place: in day time - flag "BRAVO" according to the International Code of Signals; at night - a red light visible around all quarters (at least 3 mile visibility range).

3.1.5.      In port waters it is forbidden to use audible and visual signals which are not stipulated in the COLREG-72, General Rules and these Compulsory Regulations.

3.1.6.      The shift-daily planning works (SDP) in the port were fulfilled daily for the compilation of the plan of mooring works in Odessa port. These planning works shall be fulfilled until 12A00 o'clock of the present day.

The following information should be taken into consideration during the compilation of the SDP:

  • Date, confirmed by the port, for the processing of the vessel (docking);
  • Priority of arrival of vessels in accordance with the notices;
    • Availability of free berths (docks) on the complexes, on which the processing (repair) of the vessels was confirmed.

The information for compiling the SDP shall be presented by the consignor, charterer, ship owner, forwarding agent, and vessel's marine agent to the Main Controller's Office of the port as the vessel approaches in accordance with the rules, established by the restatement of the Odessa port. The plan of the mooring works for Odessa port shall be compiled taking into consideration the requirements of CR, as well as, requirements of safety of navigation and the marine practice.

The correction of the shift-daily planning works (plan of mooring works) is fulfilled by the Main Controller's Office of the port under the agreement with ISPS and State Enterprise "Delta-Pilot".

3.1.7.      To obtain a permit for placement and working of dredgers in port waters, the Master - dredge master submits 3-copies of placement diagrams and dredger work areas as well as the dump barges routes to dumping sites. Such diagrams are to be coordinated with the ISPS and approved by the Captain of the port.

3.1.8.      Floating cranes and other vessels executing complicated and dangerous works with high-tonnage vessels at berths or in the roads fly in day time two flags R (ROMEO) and Y (UNIFORM) according to the ICS, and at night -red and green lights one above another that are visible around all quarters. A passing-by vessel should move at the minimum speed.

3.1.9.      When an anchor or other objects that present danger to navigation are lost or found in Port waters, the Master of the vessel must immediately inform the Captain of the port.

3.1.10.   All vessels are forbidden to make soundings when proceeding in channels and passages to the Port, moving in Port waters and lying at the Port berths.

3.1.11.  The conservation zone of the marine hydrometeoservice (hereunder called as "MHS") "Odessa-port", is limited by the radius 200 meters with the center in the MHS (latitude - 46°29'29" N, longitude - 30°45'39"E). The navigation of all floating craft and vessels and fishing is prohibited in the conservation zone from the side of open sea.

 

            The navigation of all vessels and floating craft in the area, limited by the intersection of the lines of 25 m distance from the dock at the head of the quarantine pier and the road pier (see annex No 4), is prohibited in the inner water area of the port.

 

3.1.12.  The port accepts vessels, which draught is not more than 12 meters, length 240 meters and width 40 meters, to the inner water area (see point 1.7.). The port can accept vessels with bigger dimensions and bigger draught, mainly, which have good maneuvering propulsion device with enough power, if the navigation and weather conditions are favorable and if the tugboat provision is enough. The mooring and departure of such vessels will be fulfilled under the agreement with the Captain of the port. The final decision concerning the entrance/departure of such vessels shall be accepted by the Master of the Vessel.

 

            The ballast vessels, which are coming for mooring in the port, shall have enough quantity of ballast, which will provide the normal navigation of the vessel.

 

3.1.13    Vessels with draught 11 meters and more, which are located in the port waters, are regarded as vessels, which are straitened with their own draught. These vessels shall carry lights and signs, established by the rule 28 of the COLREG-72.

 

3.1.14    The speed of the vessels shall not be more than: in the water area and pass-through channel - 6 bends.

In any case, the main engine shall work in maneuver regime.

The sailing of the hydrofoil vessels in the water area of the port and in the

Pass-through channel is permitted only in the displacement condition.

3.1.15. The speed of the vessels during the approach to the port and at the internal road is established by the PRVN individually in each case. Notice: The requirements of the point 3.1.14 is not including the tugboats and fire boats, which are sailing to fulfill special task, but their speed shall be in the level, which will provide the safety of the vessels, stopping at the berth or moored by the second hull.

 Traffic control

 3.1.15    Traffic of all vessels in Port waters is controlled by the Traffic Control Station of the PRVN system located on the berth No 1 (latitude - 46°29'5" N, longitude - 30o45'6"E).

3.1.16    The PRVN pilot-operator operator makes use of the high-resolution coastal radar and provides for:

 

  • Steering of vessels from the control zone borders to dry-cargo port through the west entrance to the quarantine, new and cabotage harbors;
  • Steering of vessels from the control zone borders to anchorage No.355;
    • Steering of vessels from the port through the west entrance and from anchorage .No.355 outside the area of regulated waters;
    • Steering of vessels to the oil harbor and to the berths No 46 (No 32) and No 47 (No33) through the pass-through channel and vice-versa;
    • rendering assistance to vessels within control zone in positioning, assessing the situations and divergence with other vessels.

3.1.18. The PRVN range covers the water area limited by the coast line,
meridian 30°54,9' E, bearing 177°, and from the point with the following
coordinates: latitude - 46°29,5' N, longitude - 30°45,6' E and all other
surrounding in radius 8 miles, traced from this point.

The specified operation range is the PRVN control zone. In its zone the PRVN executes functions, has the rights and duties regulated by these CR and PRVN Provisions, as well as, by the Rules of navigation and pilot steering of vessels in the north-west part of the Black Sea.

3.1.19. Irrespective of visibility, the PRVN functions and provides service
round-the-clock which is to be paid according to the established procedure,
at fixed rates, based on bills issued by the PRVN pilot-operator.

All vessels following in the control zone are obliged to use the PRVN services. The ships and vessels of the Naval Forces and Marine security of State Border Service of Ukraine are served free-of-charge. The vessels belonging to the port and which are under the management of the port shall use the PRVN services after presenting an application in the conditions of limited visibility less than 1000 meters at the internal road. The radio-location steering in the zone of control, irrespective of the belonging, is obligatory for:

  • Passenger vessels, gas carriers, chemical carriers, ferry boats, tankers and unique vessels (barge carriers, container ships, Ro-Ro) and vessels, which length is more than 200 meters);
  • All the vessels during the anchoring at the anchorage No 355 and during the weighing anchor at the anchorage No 355.

Notice: Radio-location steering is an active type of radio-location service.

3.1.20. When mooring and navigating in the PRVN zone, vessels are obliged
to keep a permanent watch on VHF, channel 14.

 

3.2. NAVIGATION OF VESSELS


General conditions

3.2.1.      The navigation of the vessels in the port waters and in the control zone is fulfilled mainly by the fairways and recommended routes.

3.2.2.      The navigation at the pass-through channel is one-way.

3.2.3.      The service-auxiliary and the small-size vessels, as well as, boats and vessels, based at the yacht complex of the port, shall use the west, east and north entrances for navigation under the agreement with PRVN.


Movement of vessels

3.2.4.      Movement of the vessels in the control zone and in the port waters is regulated.

3.2.5.      A vessel must request the permit from the PRVN for all operations (entering control zone, anchoring, leaving anchorage, mooring and leaving berth, shifting, mooring sidewise). If a vessel has not started the permitted action or has not entered the control zone within 30 minutes, the permit is cancelled and should be requested again.

3.2.6.       Entering port waters and moving of all vessels and floating craft without the PRVN permit is forbidden.

3.2.7.       Vessels are obliged to repeat the PRVN recommendations and orders that are addressed to them; if said recommendations and orders may not be fulfilled, vessels should explain the reasons and inform on their further intentions.

Notice: All helmsmen and operators are strictly observe "Guidance on usage of USW communication at sea.

3.2.8.    During the first radio contact with the PRVN the vessel should submit the
following information:

  • name and type of the vessel;
  • time of approaching to control zone or of leaving the berth;
  • speed in maneuverable mode;
  • national and departmental affiliation;
  • address of the consignee;
  • gross and net register tonnage;
  • kind and quantity of cargo;
  • length and width of the vessel;
    • Other information on request of the PRVN pilot-operator. The Master is responsible for authenticity of this information.

After finishing the maneuver of the vessel for anchorage at the berths No 354 and 355, the PRVN pilot-operator shall inform the ISPS the name of the vessel and the time of anchorage.

3.2.9.    On the PRVN demand and with the purpose of vessel identification, the latter must report her bearing and distance from Vorontsov lighthouse or execute an identification maneuver.

3.2.10.                          Afterwards, the PRVN issues the permit to the identified vessel for entering the control zone, specifies the route and gives the other necessary information, including warnings and restrictions.

3.2.11.                          Fulfillment of the deviation works in the control zone can be done only by one vessel, if its length is more than 180 meters, with the deviator on the board of the vessel and under the permission of the PRVN.

Navigation at poor visibility

3.2.12.                          At visibility less than 500 m, the traffic of all vessels (except gas carriers) at the water area of the port shall be fulfilled after the application of the Master of the vessel to the channel 14 VHF about the readiness of the vessel for movement and absence of objection from the ISPS.

3.2.13.                          Traffic of service-auxiliary vessels at visibility less than 1000 m - in the outer road, and 500-1000 m - in internal port water area, is allowed only for those vessels that are equipped with a serviceable radar system, have 2 navigators, who are trained with in a radar-simulator, proceed independently and are piloted by the PRVN pilot-operator in the zone of visibility of Coastal Radar Station. Possibility of such vessels traffic in each concrete case is solved by the PRVN pilot -operator.

3.2.14.                          Radar-tracking steering of vessels into the port can be fulfilled by the request of the Master, while at visibility less than 3 miles is obligatory. Radar-tracking steering of passenger vessels, gas carriers, chemical carriers, ferry boats, tankers and unique vessels, barge carriers, large-capacity vessels and Ro-Ro vessels is obligatory irrespective of the visibility. Depending on the situation, the radar-tracking steering can be prescribed by a decision of the pilot - operator.

3.2.15.                          A possibility of entering and leaving the port at the limited visibility under radar-tracking steering is determined by the Master of the vessel, a Port pilot and the PRVN pilot-operator in common with the participation of the Masters of the Tugboats, participating in this operation.

The final decision on a necessity of radar-tracking steering is taken by the Master of the vessel and the port pilot taking the actual visibility into consideration

3.2.16. At limited visibility, only two vessels can be piloted by the PRVN radar-tracking steering simultaneously.

The possibility to pilot two vessels simultaneously is accepted, in each individual case, by the senior PRVN pilot-operator.

3.2.17. The Coastal Radar-Tracking Station may pilot only those vessels that have serviceable main engine, steering and anchor gear, radar, VHF equipment, gyrocompass and sound alarm.

During radar-tracking steering the Master of the vessel must be ready to take measures to ensure safety of the vessel in case of a sudden failure of the Port Coastal Radar Station or communication link between vessels and the PRVN, as well as of the mechanisms and arrangements listed in this item. Pilot - operator must be immediately informed about such failures.

3.2.18. If the Master of the vessel makes use of the information supplied by the Port Coastal Radar Station, he is still not relieved of the responsibility for vessel control and safe navigation.

3.3. RULE OF THE ROAD

3.3.1.       The vessels, sailing through the pass-through channel, have the priority right to enter with respect to the vessels, sailing at the intersection of the channel.

3.3.2.       The passenger boats and the pilot boats, during the sailing at the water area of the port, shall give the way to transport vessels, hydrofoil vessels, vessels, which are occupied by the towing and fuelers.

3.3.3.       The divergence and passing of the vessels in the pass-through channel, in the inner water area and at the marine gate of the port is prohibited.

3.3.4.   The passing of the tugboats, which are fulfilling the towing of the vessels in the port waters is prohibited with the passing speed more than 6 bends and the distance less than 0.5 cable's lengths to the towing object.

 

3.4.   TRAFFIC CONTROL OF VESSELS AND SHIPS OF THE NAVAL FORCES OF THE ARMED FORCES OF UKRAINE AND THE MARITIME SECURITY OF STATE BORDER SERVICE OF UKRAINE

3.4.1.      The vessels and ships of the Naval Forces of the Armed Forces of Ukraine and the Maritime Security of State Border Service of Ukraine (hereunder called as navy vessels and ships) arriving to the Port are guided by the general rules and these CR to the appropriate extent, established in the sections 1, 2, 3, 4, 5, 6, 7, 9 and 10.

3.4.2.      The navy vessels and ships shall fulfill the sailing in the control zone under the control of PRVN. The orders of the PRVN pilot-operator concerning the security of navigation are obligatory to the Masters of the navy vessels and ships. In the case there will be a requirement to change the regime of navigation and order of entrance/departure, established by the PRVN pilot-operator, these questions should be agreed between the operative officer on-duty of the naval base or detached forces of maritime security and the PRVN pilot-operator. The Masters of the navy vessels and ships have no right to change the orders, given to them by the PRVN pilot-operator, up to the moment of receiving new orders from the PRVN pilot-operator.

3.4.3.      The operative officer on-duty of the naval base or detached forces of maritime security shall inform the traffic controller of the port at least one hour prior to the departure or supposed entrance of the navy vessels and ships into the port waters.

3.4.4.      Navy ships and support vessels have priority in entering and leaving the port with the exception of emergency situations in the Port.

In the case of entrance (departure) of the navy vessels and ships, which require the pilot steering and towing, the applications for the entrance/departure shall be presented to the Senior Traffic Controller up to 10:00 o'clock of the foregoing day. The entrance/departure in this case will be fulfilled in accordance with the SDP of the Odessa Sea Commercial Port.

 3.5.     SECURING THE NAVIGATION OF THE GAS CARRIERS IN THE PORT, PORT WATERS AND DURING THE MOORING TO THE BERTH.

Entrance of the gas carrier to the port

3.5.1.      The Masters of the gas carriers are obliged to inform the Captain of the port about the time of arrival 72 hours prior to arrival and to specify the time of arrival 24 hours prior to arrival of the vessel to the zone of round movement of the system of division of vessels. The Masters of the gas carriers shall provide the Captain of the port the initial information about the good technical conditions of the vessels before the mooring of the vessel to the berth. Any faultiness shall be agreed independently

3.5.2.      Except the main documents, the certificate of training for the safety exploitation of the gas carriers for all crew shall be presented to the ISPS for the registration of the departure of the gas carrier.

3.5.2.       The gas carriers, if required, can be anchored in the south part of the anchorage No 354 in the points with the following coordinates:

1.). Latitude 46°25,6 N; longitude 30°53,5 E;

2.) Latitude 46°26,1 N; longitude 30°53,5 E;

Navigation of the gas carriers in the port waters

3.5.4.       During the fulfillment of towage works of the gas carriers with the non-decontaminate tanks, the ballast from (to) the place of embarkation (disembarkation) of the port's pilot or from the anchorage and vice versa is permitted only accompanied by the security vessel (tugboat), which is participating the towage works. The security vessel (tugboat) shall be moving in front of the gas carrier at the distance 5-10 cable's length and notify all the vessels about the movement of the gas carrier. The other vessels shall give the way to the gas carrier and shall not approach the gas carriers for the distance les than 10 cable's lengths. The escort can be fulfilled by the tugboat, which has good fire protection means, good VHF station and good set of isolated air-respiratory apparatus for all the crew on the board. All the crew shall have the certificates about passing the training courses for the persons, servicing the gas carriers.

3.5.5.       The sailing of the gas carriers at the daytime with the visibility less than 2 miles, at the nighttime with the visibility les than 5 miles and during the bad navigational conditions is prohibited.

3.5.6.       The gas carriers have the advantage over the other vessels at the approaching roads to the port: the entering over the leaving.

3.5.7.       The radar-tracking steering is obligatory for the gas carriers.

3.5.8.       The pilot steering of the gas carriers is fulfilled only if the wind force is not more than 6 points (in ballast - 5 points). The use of two tugboats is obligatory during the towage works. One of these tugboats shall fulfill the function of security tugboat simultaneously.

Mooring of the gas carriers to the berth

3.5.9.    The territory of the berth for the gas carriers and the 35 meter water area around the ship are regarded as danger zone. The entrance of all type of vessels (except the vessels, which are servicing the gas carriers by the permit of PRVN under the agreement with ISPS) is prohibited.

3.5.10. Before starting the cargo works, the check-list about the readiness of the gas carrier for the freight operations signed by the Master of the vessel, responsible representative of the terminal and the representatives of the administration of the port shall be presented to the ISPS. If it will be required, the readiness of the gas carrier for the freight operations can be confirmed by the independent survivor, whose work shall be paid by the ship owner.

3.5.11    During the mooring, the gas carriers are prohibited to keep the towage ends on the automatic winches in the automatic regime of their work.

3.5.12    The accidental towage ends shall be lowered from the marine side of the vessel at the distance 2-3 meters from the water during the mooring of the gas carrier to the berth.

3.5.13    The cargo works are prohibited during the movement of the vessel more than 2 meters along the berth or from it.

3.5.14    During the mooring of the gas carrier to the berth, two tugboats, which force is not less than 882 kilowatt (1183 horse power), shall be located in the port.

3.5.15    During the whole period of mooring of the gas carrier to the berth, the security tugboat, which power is not less than 882 kilowatt, shall be located in the zone of these berths, ready to offer the required assistance in the case accidental situations. The fire-prevention post shall be located at the berths of mooring of gas carriers during the whole period of location of gas carriers there. The payments for the duty of the security tugboat and fire-prevention post shall be done in accordance with the established rates.

3.5.16    The radio-specialist shall be on the board of the gas carrier during the whole period of mooring of the gas carrier.

3.5.17    The repair works related to the decommissioning of the main engine, steering and anchor arrangements shall be preliminarily agreed with the Main controller Office and the Detached force of military fire protection of the port. The gas carriers shall fulfill these works at the internal road and shall obligatory request the security tugboat, which shall be located near the board of the vessel and fulfill the radio-watch at the channel 16.

3.5.18    The cargo standers shall be heaped up before the mooring of the gas carriers.

3.5.19    The representative of the pump station, experienced in English language, shall be located on the board of foreign gas carriers, which are under the freight operations.

3.5.20    Te responsibility for the accidents, happened to the people during the fulfillment of freight operations for the reason of faultiness of vessels' freight equipment, is on the ship owner.

 4. SPECIAL CASES OF VESSELS NAVIGATION IN PORT WATERS

4.1. TOWAGE OF VESSELS IN PORT WATERS AND TOWAGE WORKS

4.1.1.      The tugboat towing vessels, lighters and other floating craft of 1,415 m3 gross capacity (500 reg. ton) and larger in Port waters operate under command of the towed vessel Master.

4.1.2.      Towage of vessels and floating craft of gross capacity less than 1,415 m3 (500 reg. ton) and of non-self-propelled port fleet vessels - irrespective of their gross capacity - is carried out by the navigator of a towed vessel, if it is not provided otherwise in the towage contract.

4.1.3.      All vessels having length of 100 m and more are obliged to use at least one tugboat at mooring operations, excluding vessels, which length is les than 100 m, which are using maneuvering device.

Depending on weather conditions, additional tugboats can be ordered by the Master as agreed with the pilot.

The Master of the passenger vessel decides about the necessity of tugboats during the towage works. The Master will be responsible for the securing of towage works.

4.1.4.    Masters of tugboats are forbidden to leave barges and other non-self-
propelled floating craft in Port waters lying at anchor without the permit of
the PRVN pilot-operator and co-ordination with the ISPS.

The control of fulfillment of this point is the responsibility of the PRVN pilot-operator.

4.1.5.      During the freight operations at the internal road, the tugboats are prohibited to leave floating cranes and other floating loading equipment at the side of the vessel without arranging the question with the Master of the vessel and the ISPS.

4.1.6.      The Master of the vessel is responsible for safe lying of a floating craft moored alongside a vessel.

4.1.7.      The tugboats, during the towage works, meets the vessel, which is entering the port, at the distance 12 cable's length at the east of the Vorontsov lighthouse. In the case of bad weather conditions, the place of meeting can be changed under the agreement with the pilot and the Master of the vessel.

4.1.8.      The Master of a vessel requests tugboats via the agency company not later less than 2 hours before the vessel is ready for towage or departure.

The Master of a vessel calls tugboats 30 minutes before the vessels is ready to sail or shift, or vessel's arrival from the sea to the gates of the Port via the steering service operator through the channel 14.

4.1.9.      The vessels provided with bulbs throw the tow rope with the aid of the
heaving line. The place of receiving of heaving line shall be agreed with the
Master of the tugboat.

4.1.10.  A vessel longer than 150 m with shutdown main engines or steering gear must, when being towed in Port waters, make exhibit lights and colors prescribed by Rule 27 of COLREG-72, in addition to the lights prescribed by Rule 24.

4.1.11.  Towage of vessels working (working up) their main engines should be effected with the shortest possible tow cable so as to ensure safety of towage.

4.1.12.  During towage of non-self-propelled vessels with stern gear, a helmsman should stay at the rudder.

4.2. NAVIGATION IN ICE

4.2.1.      To manage steering in ice within Port waters, the Port Manager annually appoints the command group in charge of steering in ice headed by the Captain of the port.

4.2.2        The action, time and duration of the ice condition in the port shall be announced by the Captain of the port. The organization and control of ice steering of vessels during the approach to the port and within the water area of the port is fulfilled by the Captain of the port. During the action of the ice condition, the ice charge is collected from the freight owner in accordance with the Order of the Ministry of Transport of Ukraine No 188 as of 12.03.2003 (with additions and amendments). In the case of absence of ice in the water area of the port, the ice conditions will be announced in accordance with the Order of the Ministry of Transport of Ukraine No 188 as of 12.03.2003 from February 01 till February 14. In this case, the freight owners will not be free from the ice charge, independent of presence of ice in the water area of the port.

4.2.3        During the action of the ice condition, all the services and departments of the port will be under the managing of the Head of command group for ice steering concerning all questions, related to the ice operations.

4.2.4        The Head of Port fleet and all shipowners based in the Illichivsk Port must annually submit to the Harbour Master the lists of all vessels allowed to navigate in ice by the 1 December.

4.2.5        Forming of convoys, establishment of priorities in entering and leaving the Port, management of icebreaking means in Port waters is executed by the Chief of command group in charge of steering in ice - the Captain of the port.

4.2.6        Under complicated ice conditions, priorities of steering operations in ice are established at the working meeting with the Captain of the port and entered in day-plans of icebreaking and traffic operations (mooring) of the Port.

4.2.7        The Masters of the vessels, which are allowed to sail independently in ice, shall inform about their position, ice condition and speed in ice each 4 hours to the Captain of the port of recall.

4.2.8        Masters of vessels navigating should take guidance from the "Rules for vessels piloted by ice breakers in ice" and by the "Instruction for communication of vessels navigating in ice".

4.2.9        The Masters of vessels that are not classified for sailing in ice are forbidden to enter and navigate in ice.

Notice: By way of exception, the ship owner may permit his vessel, which has not been classified for sailing in ice, to move in ice by agreement with the Chief of command group with the appropriate icebreaking support. The responsibility for possible damage of such vessel during navigation in ice stays with the ship owner.

4.2.10.  The request for icebreaking support in entering the Port should be submitted 48 hours before the operation begins, and specified 24, 12 and 4 hours before entering the VTCS control zone or the ice edge. The request for icebreaking support when leaving the Port should be submitted 24 hours before the departure.

4.2.11. The request should indicate:

  • the name of a vessel;
  • main dimensions;
  • draught;
  • main engines' capacity;
  • daily stock of bunker and water available;
  • speed in clean water;
  • propeller material;
  • total quantity of cargo;
  • certificates for navigation in ice;
  • the vessel's seaworthiness at the time of approach to the Port.

4.2.12. Foreign vessels not authorized for ice navigation are accepted for

steering in ice only if the Master requests steering in ice in writing and pays the expenses for repair of possible damage of the vessel due to ice.

5. STAYING OF VESSELS IN PORT

5.1.
GENERAL PROVISIONS

5.1.1.      In dark time berths should be fully illuminated.

5.1.2.      At all vessels the outlets from hulls for steam and water should be equipped with means preventing ingress of water or other materials to the berth.

5.1.3.      Notification of vessels from the shore, staying at berths, is provided with natatorial means under the request of agent for the name of Chief Controller.

5.1.4.      On vessels standing at berths it is forbidden to conduct outboard works offside without agreement with ISPS and Main Controller Office of the port.

5.1.5.      At changing of mooring area of foreign vessels the PRVN pilot-operators should notify the Border Authorities about such.

5.1.6.      In case of violation by members of crew the General Rules of standing in port or the public order they are imposed a fine.

            Crew member of the foreign vessel in these cases may be divested from right of going to the shore by the Border Authorities.

5.1.7.      Approaching of port vessels or other departmental vessels to foreign ships lying at berth or on roadstead may be executed after obligatory notification of the Border Authorities.

5.2.
VESSELS LYING IN THE ROADS

5.2.1. Anchorage No.355 has 7 points for vessels mooring:

Point 1: latitude - 46°31'23,4 N; longitude - 30°46'12,0 E.

Point 2: latitude - 46°31'28,8 N; longitude - 30°46'37,2 E.

Point 4: latitude - 46°30'58,8 N; longitude - 30°46'16,2 E.

Point 5: latitude - 46°31'07,2 N; longitude - 30°46'48,0 E.

Point 7: latitude - 46°30'39,6 N; longitude - 30°46'28,2 E.

Point 8: latitude - 46°30'49,2 N; longitude - 30°46'57,0 E.

Point 10: latitude - 46°30'30,0 N; longitude - 30°47'07,2 E.

At anchorage the next order of vessels' mooring should be kept:

-         Point 7 is intended for vessels with draft up to 10 m and width up to 260 m. At mooring to the point No.7 of vessel with length more than 200 m the adjacent points No.4, 8,10 should be free from any natatorial means.

-         Points No.l, 2, 4, 5, 8 and 10 are intended for vessels with draft up to 6,5 m and length up to 200 m.

-         Point No.12 (with coordinates: latitude - 46°30'18 N; longitude - 30°47'81 E) is at the disposal of the Master of the Port for the event of immediate and unforeseen vessels' mooring.

            Berth No.355 is intended for mooring of Ukrainian vessels only. For mooring of foreign vessels it is necessary the permission of State Border Service.

5.2.2.     Berth No.354 is intended for mooring of large-tonnage vessels, tankers, vessels with hazardous cargo, and also of other vessels waiting for entering the Odessa Port.

At berth No.354 vessels should be moored independently under the control of PRVN, keeping the distance of 5 cable's lengths between the vessels after anchor is delivered. The anchored vessel should necessary notify the PRVN about bearing and distance to the vessel from Vorontsov Lighthouse.

5.2.3.        Lying of vessels in the roads for production of cargo and other operations of natatorial cranes, lighters, barges, port grain loaders and other cargo-handling crafts should be coordinated with the PRVN.

5.2.4.        At anchorage of vessels at berth No.355 the large-tonnage vessels should be anchored only to the Point No.7. Large-tonnage vessels are obliged to take into account their length and veered anchor chain length so as to stay within the anchorage limits while making circulation.

Master of such vessel for providing of safe mooring, under adverse hydro-meteorological conditions should order tow support from present in the port at the expense of the owner of vessel.

At anchorage such vessels should provide contiguous track watch at the bridge and permanent connection at 14th channel of RTS VHF with PRVN.

At anchorage of large-tonnage vessels to the point No.7 and for the whole period of their staying on berth the points No.4, 8, 10 should be free of vessels and other any natatorial means.

In accordance with the place defined by the Harbor Master, within the anchoring area of the port 354, the following point for the off-shore cargo discharge with the positional data: latitude - 46° 29'.7 N, longitude – 30° 51'.5 E, radius 4 cables was determined.

 5.3. MOORING AT BERTHS

Mooring at berths

5.3.1. Mooring (No. of berth, towage side and mooring), should be determined:

-         -for all vessels excepting passenger ones - by the Main Controller Office of the port under agreement with ISPS; For passenger vessels - by the Head of passenger terminal and is to be agreed with the Main Controller Office of the port and ISPS;

-         For vessels of yacht complex SE "OMPT" - by the Controller Service of sea club TCF.

Questions connected with vessels mooring at berths No.29 (No.34-B), No.30 (No.35-B) with floating berths No.1,2, berths No.31 (No.36-B), No. 34 (No.39-B) and departure from them should be coordinated with operative on-duty of naval base (tel.: 723-21-15).

Analogical questions concerning berths No. 33 (No.38-B), No.32 (No.37-B) with floating berth should be coordinated with operative on-duty of the marine security brigade (tel.: 729-35-71).

5.3.2.        Mooring of any vessels and floating means to the Old wave breaker is possible only at presence of mooring scheme, coordinated with the Office of Port Captains and Harbor Master.

5.3.3.        The next order of mooring is determined:

 

-         No.12, 13, 25, 26, 45 (31), 47 (33), 5h - by port side for large-tonnage vessels with limiting draft for these berths;

-        N0.8 - by port side;

-         No. 46 (32) - by starboard side;

-         No.l Oil harbor - by starboard side for large-scale tankers;

-         Other berths - towage side should be determined by the Controller of the Port under consent of the Vessel's Master.

 

Remark:

            In case of productive necessity changing of towage side of the vessel to the berth, excepting berths No.45, 46, 47 (31, 32, 33), is possible only under the consent of the Captain of the Port, under consent of the vessel's Master and with including to change-daily plan of vessels moving (mooring operations).

           At presence of vessels at the 1st section of the berth N0.8, the mooring of vessel to the 2nd section of the berth N0.8 should be made only by the port side.

5.3.4.        Mooring of vessels at berths of Complex on oil transshipment, and mooring of vessels to the berth No.5-6 should be determined by the Rules and Schemes confirmed by the Director of the Complex on oil transshipment, under the coordination with the Captain of the Port and under consent of the Master of vessel.

5.3.5.        At simultaneous mooring of container vessels with the length up to 150 m to the berth No.2, firstly should be made mooring to the 2nd section and then to the 1st.

             At mooring of passenger vessels to the berth No.15, 40 m should be free of the berth No. 14 from the convergence angle of these berths. At mooring of large-tonnage vessels to the berth No.13, 40 m should be free of the berth No.14 from the convergence angle of these berths.

            Remarks to the articles 5.3.6 and 5.3.7.:

In case of productive necessity and only after mooring of vessels to the berths No.13 and 15 the mentioned distance - 40 m - can be reduced under the coordination with ISPS.

 

5.3.8.     Berths No.3 and/or No. 11 "B" should be released from vessels and floating
means at entering the Quarantine harbor or at departure from it in the next
events:

1)    Both berths should be free - No.3 and No. 11:

-         at entering and departure of large-tonnage vessels with length more than 200 m;

-         at entering and departure of vessels with length from 100 up to 200 m at wind of more than 9 m/sec or, is the vessel is in ballast.

 

2)      One from these berths should be free - No.3 or No.11 - for entering and departure of vessels with the length from 100 up to 200 m with cargo.

3)      Concession from mentioned demands is possible under coordination with Captain of the Port and under consent of the Master of vessel in each concrete case.

            Remark: Subject to concrete dimensions and state of vessels hydro-meteorological conditions and vessel mooring at berth No. 25 the placement of vessel to the berth No.26 or departure of the vessel from berth No.26 can be made under coordination with the Captain of the Port.

Mooring at berths of oil harbor

5.3.9. Oil Harbor of Odessa Port can accept tankers with the next dimensions:

5.3.10. With the purpose of safe berthing and provision of vessels emergency exit from Oil harbor, the following layouts of vessels mooring should be used:

  • In case of mooring of vessels of more than 240 meters long and more than 40 meters wide to the berth № 2 Of Oil harbor, the vessel's bow should not be beyond the berth № 2h limits more than 20 meters, and the stern should not be beyond the mark of 235 meters;
  • In case of berthing and de-berthing to/from berth №1h of the vessel more than 200 m long with large-capacity tanker at berth № 2h that goes beyond the corner of berth № 2h., the tanker moored at berth № 2h should be moved prior to beginning of berthing operations so that its bow part does not go beyond the corner of berth, and after berthing and de-berthing of the tanker at berth № 1h, to return the tanker at berth №2h in starting position - under cargo standers.
  • In case of mooring of the tanker of more than 170 m long to berth № 5h, the berth № 4h should be free.

5.3.11 Processing of vessels - gas carrier in oil area is carried out at berths № 4h and № 7h.

5.3.12 If south, southeast, east and northeast wind has speed more than 10 m/s, berthing of gas carrier and cargo operations at berth №7h are not allowed. In case of deterioration of weather conditions the vessel's master should stop cargo operations and prepare the vessel for immediate de- berthing at the ship owner's expense.

Preparation of berths for mooring vessels

5.3.13. All port berths, including Oil harbor, should have external marking with indication of berth's length in meters and distances between mooring pedestals. 3 meter mooring zone should be free from cargoes and foreign objects to provide safe operation of coastal sailors in berthing operations.

            In winter time quay apron of berth should be free of ice and snow and sanded. The place of vessel mooring should be marked: in the daytime - by flag; at night -by lantern.

            Responsible for maintenance of berth in proper condition are: persons appointed by heads of the stevedore companies (shipyard) and Administration under the authority of which are these berths.

5.3.14. The persons responsible for fulfilling of the requirements on berths
preparation to berthing and de- berthing of the vessels are:

  • Port dispatcher;
  • Chief of PPK (or persons appointed by the heads of stevedore companies, shipyards);
    • Harbor master;
    • Dispatcher of Port fleet administration
    • Other persons responsible for berths.

5.3.15. Dispatcher (stevedore) of PPK or stevedore company informs the port dispatcher about berth preparedness. Then, the port dispatcher informs pilot and TCS operator about berth preparedness and determines time of vessel's anchor weigh and berthing.

                     In any case the pilot, before exit of the vessel, is obliged to receive beforehand an evidence of berth preparedness for the vessel and to report the result to the port dispatcher and to the Chief of ISPS shift.

5.3.16. Berthing of the vessels to the berths that are not duly prepared is prohibited.

            If the pilot left for vessel, and the berth was found to be unprepared for whatever reason for reception of vessel, IPGN representative should inform the pilot and the port dispatcher thereof. The vessel bounding from the sea to mooring, under the recommendation of the pilot, should be put on anchor in 12th point (latitude - 46°32 ' 02 " N, longitude - 30046 ' 04 " E) or on internal roadstead with towing provision up to full preparedness of mooring. Each case of berth unavailability should be reported by the pilot in the Report of breach of Obligatory provisions.

5.3.17. Cargo handling operations and circulation of people on the decks for the period of mooring of the vessel should be stopped on the vessel to the board of which other vessel is berthed or de-berthed.

Approach to berths and mooring operations

5.3.18.         During mooring, de-berthing or pulling of the vessel, representative of port PPK or of stevedore company and IPGN representative with portable ultra short waves radio station for communication with TCS and pilot on the vessel are obliged to be present on the mooring.

5.3.19.         Owing to structure features of passenger pier, during berthing, de-berthing or pulling of passenger vessel, the following persons should be present at moorings № 15, 16, 18, 19:

•          IPGN Representative ISPS and shift assistant of Harbor master - on the mooring in area of vessel mooring;

5.3.20. Receiving and casting off the vessel ropes in the period of berthing
operations are carried out during berthing and de-berthing of the vessels, irrespective of the purpose of their berthing in dry-cargo port - by employees responsible for mooring of Port fleet administration. The berthing team is to be called by the pilot through the dispatcher of port 45 minutes prior to the beginning of berthing operations with vessel.

5.3.21. Berthing of low board tankers with cargo of 3rd MOPOG class to Oil harbor berths is made with casting off the right anchor so that the deck of the vessel will not be caught under bumpers of a berth.

The tanker's master may weigh an anchor only after rise of the vessel's deck up to the level of mooring top.

5.3.22.         For safe berthing of tankers to Oil harbor moorings in hard meteorological conditions, the anchor may be dropped and upon termination of Oil harbor and prior to the beginning of cargo operations should be weighed and put on its place in hawse.

5.3.23.         The Master should lodge to Port authorities all claims regarding damage of the vessel inflicted during mooring or cargo operations not later than 8 hours after the accident. In case the vessel is due to depart before the expiration of this term, the claim should be submitted beforehand. After expiration of the 8-hour period the Port does not accept the claims and, also, does not bear responsibility for the damage.

5.3.24.         In the port, it is prohibited:

 

  • mooring a vessel alongside the smaller size vessel;
  • mooring a vessel in ballast to a loaded vessel of identical size;
  • mooring of passenger, scientific and training vessels alongside each other;
    • mooring vessels with unserviceable main engines and steering or anchor units to moorings №№ 10, 13, 15, 19, 21, 25, 26, 44 (30), 45 (31), 46 (32), 47 (33) and alongside other vessels staying at berths;
    • mooring of vessels to unserviceable berths;
    • Berthing of any vessel to the moorings removed from service;
      • Berthing of large-capacity vessels more than 200 meters long to moorings №№ 25, 26;
      • De-berthing by stern of large-capacity vessels (more than 170 meters long) with draught more than 10 meters from moorings №№ 25 and 26;
      • Berthing of large-capacity vessels to mooring № 46 (32) if there is any floating mean at mooring № 45 (31) and vice verse;
      • Berthing of vessels to moorings №№ 3, 8, 11 "B", 24 "B" and 25 more than one hull.

 

Note: In case of operation necessity, depending on specific dimensions and conditions of the vessels, hydrometeorological conditions and observing necessary safety measures, the deviation of these requirements can be allowed under the condition of agreement with Harbor master and consent of the vessel's master.

Is prohibited to berth small low board tankers to moorings № 1-h and № 5-h of Oil harbor because it is impossible to fix berthing ropes.

Is prohibited to perform repair and adjustment works of radar-tracking systems switching on high voltage without ISPS permission.

Lights on vessels standing at berths

5.3.25.     Vessels moored at berths for cargo operations with the hull extending beyond the berth limits should be reliably fixed. During cargo handling operations such vessels must exhibit: in day time - "ROMEO-YANKY" flag ("You should pass by at small speed"); at night - one red light visible around all quarters. Besides and irrespective of the purpose of staying, the vessel should exhibit at night the red light lowered above the water from the bow or stern to indicate the maximum extension of the vessel out of the berth limits.

 Protection of berthing

5.3.26.     Large-capacity vessels as agreed with the port captain and with the consent of the vessel's master are to be moored to berths №№ 46-47 (32-33) with the stern extending beyond the berth limits 30 meters and more depending on length of the vessel.

If the vessels stay at moorings № 46 (32) and № 47 (33) and both with stern extending beyond the berth limits, the masters of these vessels are obliged to give at least two hold-down ropes from the stern of one vessel to the stern of the other vessel. In case of offshore wind when stern of the specified courts starts to depart from mooring, the master of such vessel is entitled to ask a tow in port administration to provide safe mooring of the vessel.

The port dispatcher is obliged, on request of the master of the vessel which is moved from the mooring by offshore wind (or at his own discretion) to send a tow to provide safe berthing.

On tow's request, the vessel's master is obliged to give it reliable ship rope from the stern.

5.3.27.     Floating pier (lighter) which must be reliably fixed to mooring and have duly equipped gangway for connection with mooring, should be installed, from the stern part to mooring butt, to the vessels berthed to moorings № 46 and 47 (32 and № 33) with the stern extending a lot beyond the berth limits.

Floating pier (lighter) must be installed under main gangway which the administration of the vessel is obliged to hold suspended. The PPK-5 administration is responsible for installation of floating pier (lighter) and also of gangway for connection with coast.

5.3.28.     Owners of the vessels carrying passengers, and also owners of passenger berths, floating piers and other constructions intended for embarkation and debarkation of passengers, are obliged to provide full safety of embarkation and debarkation operations of passengers which would exclude accidents with passengers.

5.3.29.      Control over safety of embarkation and debarkation of passengers on moorings of sea port is carried out by shift assistant of Sea port chief and masters of passenger vessels.

 Change of anchorage

5.3.30.         Rearrangement of the vessels in port is made only with the pilot. Exceptions are non-self-propelled vessels with capacity of less than 500 reg. tons and vessel belonging to port which navigators have UKP permission of navigation in port waters without pilot.

5.3.31.         To vessels' masters are allowed to pull the vessel along the berth on distance up to 50 m., as agreed with UKP and Main controller's office of the port.

Thus, the following restrictions in water area of the port are introduced:

  • Ballast vessels and vessels having onboard 20 % cargo of deadweight (except large-capacity vessels) must re-berth at force of wind no more than 15 m/s;
  • Large-capacity vessels in ballast or having onboard 20 % cargo of deadweight and not having serviceable maneuvering propulsion device, Ro-Ro vessels, lighter-aboard ships, tankers, container ships more than 170 m long and similar to them (because of big windage) must be moved at force of wind no more than 12 m/s;
  • Rearrangement of the vessels with unserviceable main engines and steering or anchor units is made only in the daytime at force of wind no more than 10 m/s;
  • Rearrangement of floating cranes and non-self-propelled floating units belonging to the port is made under hydrometereological conditions according to Register documents in any time of the day in case of sufficient towing provision;
  • Mooring of vessels alongside is made at force of wind no more than 10 m/s with the consent of both masters.

5.3.32.      Each vessel, upon termination of cargo or other operations, on the first request of the dispatcher of port, must be unmoored from the berth and taken from the internal port water area at the expense of the ship owner.

If the requirements of this item are not met, such vessel is taken from the berth by the Odessa Port means and at the ship owner's expense. In doing so, the ship owner bears a full responsibility for the losses connected with delayed clearing of the berth.

Actions at storm

5.3.33. Upon receiving a storm warning about strengthening of wind from east directions (0°-90o-180o) up to 22 m/s and more, the vessels staying on anchors at anchorage No 355, on request of the pilot- TCS operator must change the anchorage:

  • auxiliary vessels and small craft should be led into port and reliably moored to berths;
  • all other vessels should anchor at anchorage No.351 or leave for the open sea;
  • the listed above rearrangement of vessels in the roads is carried out according to instructions, with the permit and under supervision and tracking of the TCS.

5.4. STAYING OF SMALL CRAFT AND FLOATING MEANS IN THE PORT

5.4.1.      All small craft and Port fleet floating means are moored, as a rule, near berths No.28 (27B and No 28B) of Practical harbor and with the permit of the Port dispatcher and of ISPS - at free port berths except passenger berths №№ 15, 16, 18,19 and 20.

5.4.2.      Mooring vessels and floating means of other departments to berths No.28 (27B and No 28B) and floating berths located on them is prohibited without co­ordination with the Port fleet administration.


5.5.
WINTERING AND LAYING-UP IN THE PORT

5.5.1.      Ships of the Odessa port fleet and of the other departments that are not of the ice category are laid-up in the Odessa port for the period of difficult ice situation.

5.5.2.      Auxiliary vessels, small craft of the Port fleet and other departments stay for wintering near the floating piers moored to berths No.28 (27B and No 28B) and floating berths located on them, if otherwise is not provided by mooring layout approved by Harbor master

5.6.
PREVENTION OF PORT WATER AREA AND PORT TERRITORY  POLLUTION

5.6.1.       All vessels staying in port water area and all enterprises, organizations and institutions located on its territory (or those that discharge into the Port water area) are obliged to comply with the provisions of legislation of Ukraine on environment protection and "Obligatory regulation". All actions related to environment protection of the territory and water area of the Port should be coordinated with the Port authorities (ISPS and OOS department). The persons guilty of violation of the provisions stated in above mentioned documents are brought to criminal, administrative and property responsibility.

5.6.2.       All vessels, irrespective of their departmental affiliation and flag that arrive to the Odessa Port are obliged to prove their conformity to Ukrainian environment protection legislation and MARPOL 73/78 International Convention. The vessels not corresponding to the above specified requirements are not admitted to the Port.

5.6.3. For all vessels, other floating means during their stay in the Odessa port waters and all enterprises and organizations located on its territory (or discharging in the port water area) to:

It is prohibited:

  • . To discharge in the sea-
  • . Cargoes transported in bulk, or in liquefied condition;
  • , Waste products, garbage and snow;
  • . The waters containing polluting substances in concentration which exceed maximum permissible concentration (MPC), except waters after cooling of ship mechanisms.
  • , Chemical raw material and products of chemical production after cleaning and washing of decks, cargo holds and tanks;

•      Crude sewage and also sewage after ship installations not meeting MARPOL 73/78 requirements and not having the corresponding certificates.

• to pollute atmosphere -

  • by excessive (over permissible) emission of polluting substances;
  • Emissions of ship incinerators for burning of waste products. Furnaces of incinerators, for the period of laying-up, are sealed by the representative of vessel and (or) persons appointed by harbor master.
    • to pollute the territory-
    • by dumping of all kinds of waste products on berth in unpermitted places and in the containers not provided for such purposes.
      • to carry out-
      • Cleaning of underwater part of hulls from fouling;
      • Ship and repair works (covering and painting of hull, washing of decks, holds and other parts of vessel) without observance of the measures excluding pollution of port water area and without their obligatory coordination with environment protection service of port and ISPS.
        • to use-
        • preparations lowering oil on bottom or dissolving it in water for treatment of port area water

It is a uthorized:

  • to discharge in the sea sewage -
  • treated in ship installations which meet the requirements established by MARPOL73/78 which are confirmed by the certificate of classification society and checked on efficiency of their work. Sewage treatment installations must be regularly exploited and according to the instruction for such system;
  • From the vessels which are not equipped with closed systems of sewage if number of persons staying onboard does not exceed 10.
  • The decision on conformity of waters quality to norms of maximum permissible concentration of substances is to be taken by nature protection authorities in the port.
    • to use-
    • for liquidation of consequences of emergency discharges, only chemical and biological preparations, (in each separate case, it should be agreed with nature protection service of the port).

5.6.4. To prevent pollution of port water area -

Vessels administration is obliged:

  • before entering the territorial waters of Ukraine to replace the separated ballast taken in the other regions of World ocean to ballast water of the Black Sea with appropriate notice in the Log-book.
  • before entering the internal sea waters and the territorial sea of Ukraine, to close all locking devices designed for discharge of polluting substances including waters containing them;
  • Discharge of separated ballast should be carried out only by ships' pumps specially intended for this purpose and by separate pipelines. Discharge of separated ballast outboard (in case of vessel's moorage at the port's berth) should be done under the supervision of the Inspection of state port survey (ISPS).
  • To accumulate garbage and polluting substances, including waters which contain them in special ship containers;
  • Before exit from the port to turn over, if necessary, for destruction (recycling, placement etc.), all kinds of waste products formed on the vessel;
  • In any operations with oil, oil products, waters polluted with oil and other harmful substances - to seal deck dales, to place trays under hoses connections and air tubes, and also to provide collection of waters accumulated on the deck containing the above-stated substances, in slopetank or in other suitable tank;
  • To register in special log-books stipulated by MARPOL 73/78 Convention (if such log-books should be kept on such vessel), all operations with oil, oil products, oil leavings, oil containing waters, garbage and other harmful substances;
  • to notify immediately port administration (master, dispatcher etc.) about any discharge of polluting substances, occurrence of threat of such discharge or in case of detection of port water area pollution. The message is made by the fastest way (radio - channel № 14; phone - 729-44-95, 725-29-33; purposely), thus, it is necessary to specify exact place of pollution, its nature, size and direction of movement;
  • To take measures for maximal reduction of discharge and liquidation of pollution consequences;
  • To present to ISPS representative the documentation confirming conformity of the ship equipment to the requirements of nature protection legislation of Ukraine and MARPOL 73/78 requirements (valid certificates, efficiency tests results, plans of pollution prevention, filled log-books etc.);

Administration of the enterprises and of the stevedore companies located in the territory of the Odessa port is obliged:

  • To observe the norms and the rules stipulated by the Environmental protection legislation of Ukraine currently in force and these "Regulations";
  • To subordinate to general control of the port, and also to provide its representatives the access for its realization;
  • To keep account and reporting in the field of environmental protection, and also to pay all payments stipulated by the current legislation;
  • To accumulate in special tanks (rooms etc.) all kinds of waste products formed on her facilities, and also to turn them over for destruction (recycling, placement etc.) - under the corresponding contracts with the organizations having the license for such activity;
  • To take measures for the maximal reduction of discharge and liquidation of pollution consequences;
  • To develop, together with the port, the actions of environmental protection and to assist in purchase of the equipment and technologies for this purpose.

5.6.5.     With the purpose not to permit discharge of polluting substances
outboard, all ship locking devices (through which discharge is possible) - should be
closed and sealed up.

Closing of all devices intended for discharge of polluting substances, including waters which contain them, is carried out by responsible officials of ship crew before the vessel enters the territorial and internal waters of Ukraine with appropriate notice in the Log-book.

These devices are sealed by the inspector of the Inspection of State Port Survey (ISPS) when the vessel is moored to the port's berth.

Payment for sealing of locking devices of the vessel is made under the tariff established in the port.

The list of the devices subject to sealing is determined by ISPS inspector during vessel survey in view of the requirements stated in cl. 2.2 and Appendix 1 to the Instructions on the order of sealing in sea trading and river ports of Ukraine of ship locking devices intended for discharge of polluting substances and waters which contain them.

Sealing of devices made by ISPS inspector does not exempt the vessel's master and ship crew from responsibility for sea environment pollution and failure to fulfill the navigation safety measures stipulated by the Code of trading navigation, and also by other acts of national legislation and international conventions.

5.6.6.     Prior to the beginning of cargo works in Oil area and at oil complex
Prista Oil-Ukraine and OPPK:

• The tankers laying at berths should be isolated by the port's slick bar according to the Instruction of slick bar. Exception for necessity of slick bar (in view of inefficiency and inexpediency), is: presence of ice in port water area, actual force of wind - more than 17 m/s and sea roughness in water area - more than 2 points;

• Representatives of the vessel, port and organization which loads (accepts) cargo should draw up, check and sign "Testing sheet of vessel - coast safety". It is strictly prohibited to begin cargo operations without getting positive answers to all questions in "Testing sheet of vessel - coast safety".

5.6.7.      If oil products "spilled" during the period of bunkering or acceptance / discharge of cargo, all operations related to this "spill" should be stopped until the reason and danger of spilled oil products are removed. Initiator of termination of the above-stated operations can be: State ecological inspection, ISPS, guilty party or party involved in pollution.

5.6.8.      It is prohibited for the vessels and all floating means to cross the water area polluted with oil products. In case of passage near to area where oil products are being removed, it is necessary to pass by at minimal speed.

5.6.9.      The vessel got in oil field during emergency spills of oil products should not begin its movement - before special authorization of the head of oil products removing or TCS (on 14 channel).

5.6.10. Collection, disposal, destruction and placement of all kinds of waste products from vessels and other facilities located in the territory of the port is made by specialized division of the port (under applications, contracts etc.), with payment under the established tariffs. Thus, operational and special waste products from vessels are to be removed without fail on specialized platform of incinerator complex, for subsequent disposal. Meanwhile waste products of 1-3 class of danger are allowed to be removed from territory of the port exclusively on the basis of the documents endorsed by OOS department of the port.

5.6.11.        Waste products from the vessels with handling operations are accepted in intact polyethylene bags put by vessel's crew in the containers provided. Polyethylene bags can be delivered by the organization accepting waste products - under corresponding application. From coastal facilities and vessels in repair: waste products of 4 class of danger are accepted directly in coastal reservoirs (containers), and waste products of 1-3 class of danger are accepted according to the rules established in the port. Payment for all services is made under tariffs of the port.

5.6.12.        Ship owners and managers of enterprises that violate the Obligatory Regulations as regards environmental protection should refund all port's expenses for liquidating pollution and its consequences as well as the Port expenses for renting equipment, floating means and personnel of other enterprises.

5.6.13.        All enterprises (organization) located in the port's territory and being independent legal entities bear full responsibility for sanitary and ecological condition of the rented territory and adjoining water area, and also for compliance with nature protection legislation at their facilities.

6. PROCEDURE OF USE OF RADIO COMMUNICATION MEANS IN

PORT WATERS

6.1.All vessels navigating in the Control Zone are obliged to have serviceable VHF radio telephone stations (RTS) which should kept switched on the 14th channel that provides for communication in the port. Additional communication with TCS is possible in DSC mode (70 channel) MMSI No 022723671.

6.3. Vessels staying within the limits of the Odessa Port Control Zone (at anchorages, at berths and in transit) may not use VHF of the Central Port Radio Station for private communication on frequency channels: 6, 8, 9, 14, 16, 30,31, 33, 67, 70, 74. Failure to comply with this clause is considered as gross violation of navigation safety in port waters (Control Zone). Administrative measures and penalties shall be applied to the violators.

7. PROCEDURE, SAFETY AND SAFE KEEPING OF CONSTRUCTIONS IN PORT WATER AREA

7.1. NAVIGATION OF SMALL CRAFT

7.1.1. Sports stations and other organizations conducting public sports competitions (regattas, races, tours, etc.) in the Control Zone must inform the Harbor Master in writing at least 3 days in advance submitting the appropriate diagrams in 3 copies.

Floating craft that assist to conduct the above sports activities must be equipped with VHF radio telephone stations and maintain permanent watch on call channel No.16. Sports stations and other organizations conducting sport activities are responsible for preparation and safe navigation of sport craft at the sea.

Navigation of pleasure yacht, boats in port water area

  • the vessels basing in yacht complex SE "OSTP", should be guided by the present “Obligatory OSTP Regulations”.
  • During vessel navigation, the watch is to be kept on 14 and 16 VHF channels under the condition of the radio communication rules observance.
  • Navigation in port waters is made under TCS control.
  • It is necessary to avoid navigation in the System of movement division.
  • The vessels of yacht complex "CTF" should navigate in the internal port waters with mechanical engine.

 7.2   FISHING IN PORT WATERS

 

7.2.1. Fishing in the internal port water area from berths as well as from any other floating craft is prohibited.

7.3   NAVIGATIONAL AIDS

7.3.1.       Masters of vessels that detected in port waters and in the Control Zone any floating objects that are dangerous to navigation must immediately inform the PRVN pilot-operator.

7.3.2.       If a vessel inflicts damage on a navigational buoyage, the Master must immediately inform the PRVN pilot - operator, who must urgently report this case to the ISPS in order to notify mariners and take measures to restore the damaged buoyage.

The PRVN operator is obliged to permanently inform all vessels navigating in the Control Zone that this particular navigational aid is out of order until the time when it is repaired.

7.3.3. Any construction of new facilities or reconstruction of the old ones located in the area of navigational aids or on the leading lines is prohibited without co-ordination with the Harbor Master, Naval Staff of the Black See Fleet and organizations that are in charge of this navigational aid.

 8. ORDER, GUARDING AND TRAFFIC IN PORT TERRITORY 8.1. PASSAGE SYSTEM AND PORT GUARDING

8.1.1.    The area and the inner water area of Odessa sea commercial port within set borders are secure and are in the custody of Maritime security service and Militarized security service of the port.

Control on obeying established procedure in State border checkpoint is monitored by State Border Service.

Security and control on keeping the requirements provided by International Code of Vessel and Harbor Craft Security are monitored by Port Maritime Security Service.

8.1.2.    All the individuals being in the Odessa commercial seaport secure area must have port passes and present them on the first order of Port Maritime security service and State Border Service.

The individuals that have passes without photos (no recurrent or temporary) must present their identification documents (passport).

8.1.3.    In order to secure constant maritime security safeguards in port within the requirements provided by International Code of Ship and Harbor Craft Security, the Master of the vessel under the convention must make use of services of Port Maritime Security Service on setting forth the constant Maritime security service post on board the vessel, with the obligatory payment according established rate (except vessels under the convention, capable of self-supporting three guard levels during the whole period of correlation with harbor craft under the convention).

Post order is telephoned in by the agent company, phone No 1-36-54. Checking on board the ships is made by State Border Service.


Cargo guarding

8.1.4. The ship owner is liable for guarding of vessels staying in the Port and of their cargo.

8.1.5. The simultaneous use of gangways set in the secure area, the vessel administration is responsible for preventing movement of people and tangible property from secure to non-secure area and vice versa.8.2. TRAFFIC AND PARKING OF TRANSPORT. PEDESTRIAN MOVEMENT

8.2.1.   Speed of transport within the territory of the Port should not exceed 30 km/h.

Transport must be parked only in the parking areas.

8.2.2.      The entrance of the private transport to the port area is prohibited.

8.2.3.      The entrance and moving in Oil district of any kind of transport and self-propelled vehicles during operations on oil cargo is prohibited.

Notice: The entrance of private transport into the port area is permitted only in case of production necessity by the Head of State Enterprise "Odessa Sea Commercial port" personally.

8.2.4.      Movement of transport and pedestrians is made through the checkpoints.

8.2.5.      Foreign citizens pass through the port checkpoint with corresponding license of border authorities.

8.3. ORDER AND ORGANIZATION OF CONNECTION AT THE TERRITORY OF THE PORT

  • To open the fire cocks and fire water pumps;
  • To sell or bring and take alcoholic drinks;
  • To damage all kinds of flowerbeds and plantations: trees, flowers, bushes


9. Fire protection regime in the port

9.1. General conditions of the fire protection regime in the port

 

 

Fire safety at the territory of the port and its objects

9.1.1. The smoking is prohibited at the territory of the port, berths, in buildings, constructions, storehouses, motor transport and loading equipment irrespective of the forms of ownership and belonging department.

            The smoking can be allowed (permitted) in the special areas, equipped for this reason, coordinated by the administration of the objects with the Department of Military Fire Protection Service, and labeled by a special signs, under the presence of bin or ashtray, made from flame-retardant material.

9.1.2. The use of forklift trucks, motor vehicles and other mechanisms, which are using internal combustion engine without the certified system of spark suppression, are prohibited in the storehouses.

9.1.3. During the load and unload of the highly inflammable cargos, the administration of the Loading-Transshipment Complex (LTC) of the district or sector should, by the request of the administration of the fore protection service of the port, supply the people to provide the fire posts at the places of freight works for the whole period of fulfilling these works.

9.1.4. The parking of the motor transport in the thoroughfares of the buildings at the distance less than 10 meters from the entrance gate, less than 5 meters from the fire hydrants and other places for collecting water, fire equipment and stock, turning places and dead ends.

9.1.5. It is prohibited to stow the cargo on the wood deck of the berth, to close the fender posts, fire hydrants and cocks by the cargo and to block up the fire passages and entrances. The free space nearby the fire cocks should be not less than 4 meters, while nearby the parking places of the fire-fighting vehicles and at the passage to the sea – not les than 9 meters in wide.

9.1.6. It is prohibited to use in the production processes and to store the substances and materials, which parameters were not studied concerning the fire and explosion danger.

9.1.7. The fire protection group of each department shall fulfill the control of execution of the fire protection regime at the objects (in the department), control of the conditions and readiness of the fire protection means.

9.1.8. All the fire pumps of the LTC and the port economy shall be ready to be used and shall be examined for the availability of the required pressure by the method of starting it not less than once per 10 days (the corresponding entry shall be done in the journal).

9.1.9. The territory of the refueling stations and the open areas for storing the liquids in packages shall be kept clean, while the spilled highly inflammable liquids shall be cleaned in time.

9.1.10. The technological equipment of the woodworking department, devices and electrical equipment shall be cleaned from the wood dust, shavings and other inflammable materials not less than once per session, while the building constructions and the electrical lights – not less than once per two weeks.

9.1.11. It is not allowed to block up the passages, doors, tambours and stairs by the different substances and equipments. All the doors of the evacuation exits shall open freely in the direction of exit from the building. The ability of quick and safe evacuation of people and tangible property, which are located in the production buildings, shall be provided in the case of fire.

9.1.12. The passages and crossroads through the inner-port railways shall be free for the fire-fighting vehicles and shall have solid flooring on the level of head of rail lines.

The parking of the vans on the crossroads without diesel locomotive is prohibited.

9.1.13. The warning inscription in Russian and English languages shall be installed at the places, visible during the day and the night in the flammable places and objects of the port. Those warning inscription shall include the following: “NO SMOKING”, “DO NOT USE THE OPEN FIRE”, etc.

            The installation of such inscriptions shall be agreed between the heads of the LTC, districts and port economies, directors of the enterprises, organizations and companies, located in the port, and the fire protection service.

 9.2. Fire protection on the vessels, located in the port

General rules of fire protection on the vessels, located in the port.

9.2.1. Bunkering of the vessels, moored at the berths of the dry cargo port and at the raid, with the liquid oil, shall be fulfilled from the floating fuelers. The bunkering of the vessels, moored at the berths of the oil district, is not allowed during the load and unload of liquefied hydrocarbon gasses, petrol and spirits.

9.2.2. The bunkering of the passenger vessels shall be fulfilled only by the use of self-propelled fuelers (if these fuelers, fore some reasons, are not self-propelled, the towboat of the port shall be located there during the total time of bunkering).

9.2.3. During the fulfilling of loading operations with the inflammable and explosive cargos, the intensified fire post shall be located on the board of the vessel or the towboat of the fire protection service shall be on duty nearby the vessel. The Master of the vessel shall present the request about the placement of such fire post or about the placement of towboat of fire protection service on duty and to pay all the expenses, related with the intensified fire oversight in accordance with the established rates.

If the Master of the vessel will not fulfill the abovementioned rules, the load of the abovementioned cargos will be prohibited.

9.2.4. It is prohibited to moor the fuelers to each other by broadside, if one of them will contain the cargos, mentioned in the art. 3.1. or 3.2.

9.2.5. The mooring of the tank vessels with the cargo or ballast of degasified tanks, as well as the vessels, which shipping on board the cargo of the third class in accordance with the rules of marine transportation of dangerous cargos, to the dry cargo berths of the port is possible only after receiving the special agreement of the Department of Military Fire Protection Service.

The mooring of the oil tank vessels with the ballast of degasified tanks to the dry cargo berths is prohibited.

9.2.6. For the towing of the inflammable vessels and for work in the oil harbor, the towboats and the towed vessels shall have the permission of the detached forces of the military-professional department and have not less than two metal fire ends (at the stem and foredeck), while the exhaust roads of the external combustion engine shall be equipped with spark extinguisher.

9.2.7. It is prohibited to fulfill on the vessels, moored at the oil harbor berths, any outboard works, including the repair works, not related to the load and unload of the cargo.

9.2.8. It is prohibited to take the main engines, anchor gears and steering arrangements of the tankers, moored at the oil harbor, to repair.

In some special conditions, arranged with the Department of Military Fire Protection Service of the port and under the permission of the Captain of the port, it is possible to repair the main engines, anchor gears and steering arrangements. In this case, two towboats with the established towing metal ropes shall be located nearby the board of the vessel during the whole time of fulfilling the repair works. The work of towboats is paid by the vessel owners. The responsibility for fulfilling such kind of works and its possible consequences is on the Master of the vessel (vessel owner).

9.2.9. It is prohibited to treat the tankers with the cargos of 1st category at the berth No 5 of the oil harbor during their mooring at the berth No 47 (33).

9.2.10. During the fulfilling of cargo works at the tankers and gas carriers, moored at the berths of oil harbor, which carry the cargo of 3rd class in accordance with the rules of marine transportation of dangerous cargos, the towboats of the fire protection service with the raid fire team for tankers and the towboats for control of gas carriers shall be on duty. The use of the towboats shall be paid by the owners of the vessel.

9.2.11. During the fulfillment of cargo operations with the inflammable, explosive, chemical and fumigation cargos and in the case of appearance of emergency conditions (explosions, fire, spill of chemical cargo, leakage of fumigation gases, etc.) the physician-toxicologist and the “Group of extraordinary medical reaction for rescuing people during the accidents” shall be invited by the phones 1-48-45, 1-31-79.

9.2.12. The fire protection services in the port are fulfilled in accordance with the beforehand presented written applications of the agent companies, masters of the vessels, heads of other enterprises and organizations, which do not belong to the port. These services, as usual, are fulfilled by the forces of the specialists of the port for payment in accordance with the local acting rates of the port.

9.2.13. All the expenses, suffered by the port, during the fighting of fires, happened on the vessels, moored at the berths, located at the water area of the port, and during the fulfillment of the fire protection security works at the vessels, are paid by the owners of those vessels.

9.2.14. The fulfillment of the electrical-gas-welding and other fire works, as well as the bunkering of the vessels, moored at the dry cargo and passenger berths, as a rule, is prohibited. In the special cases, the fulfillment of the abovementioned and other fire-hazardous works is possible (allowed) only after receiving the written permission of the Captain of the port and agreement of the head of the detached forces of the military-professional department of the port, with the obligatory fire security and payment of the offered services in accordance with the acting rates of the port.

9.2.15. The entrance of the motor transport and other self-propelled mechanisms, not equipped by the spark extinguisher and the primary means of fire fighting, to the territory of the oil district, in accordance with the acting norms, is prohibited.

9.2.16. The fulfillment of the cargo operations during the work with inflammable and combustible liquids is allowed only at the specially equipped berths of the oil district. The cargo operations concerning the load and unload of inflammable and combustible liquids at the dry cargo and passenger berths is prohibited.

The bunkering of the vessels by the use of fueler and railway cisterns immediately from the berths can be fulfilled after the preliminary agreement with the Department of Military Fire Protection Service of the port and fulfillment of the additional measures, established by the Department of Military Fire Protection Service.

9.2.17. The following is prohibited at the territory of the port:

  • Burning of garbage, dry grass and other flammable wastes;
  • Make a fire;
  • Smoking in the unsuitable places;
  • Fulfillment of fire works concerning the worming up of bitumen, electrical-gas-welding and other fire-hazardous works without the written permission of the Department of Military Fire Protection Service.

9.2.18. Fulfillment of cargo operations at the berths of oil districts concerning the transshipment of the liquefied gases are allowed only after signing the act of readiness of the vessel to the transshipment  of the liquefied gases by the representative of the Department of Military Fire Protection Service at the oil district.

9.2.19. The consignor is obliged to inform the administration of the oil district and the owner of the vessel about the readiness of the gas-rescue services, place of its dislocation and the mode of communication (phone numbers, call signs of radio communication) before the mooring of the gas-carrier vessels

9.2.20. The agent shall, 52 hours before the mooring of the vessel in the port for loading and unloading of dangerous cargos in accordance with the International Code of Transportation of Dangerous Cargos, present to the Department of Military Fire Protection Service bill of lading for the dangerous cargo, confirmation of LTC or the stevedore company about the readiness for Loading-Unloading works, place of storing the cargo, time of its storage and its removal.

10. On building, exploitation and insurance of port’s constructions

10.1. On exploitation of buildings, port’s constructions and eqipments

10.1.1. All the constructions, located at the territory of the port, shall have the technical passport.

10.1.2. The owners of all buildings and constructions, located at the territory of the port and the port-adjacent areas, are obliged to keep it in good technical order. The external appearance of the buildings and constructions shall be clean, and the adjacent territory of these buildings and constructions, at the distance up to 20 meters, shall be in good order and clean.

10.1.3. The state and public enterprises, organizations and establishments, which are located at the territory of the port, shall, by their own means and on their own account, to fulfill the daily cleaning of their areas, storehouses, warehouses and other places, belonging to these establishments.

10.1.4. Cleaning of garbage, snow and ice at the entrance railways, located nearby the storehouses, belonging and exploited by the port, shall be fulfilled by the port on their own account. The cleaning of garbage, snow and ice at the entrance railways, located nearby the storehouses, exploited by the stevedore companies or other joint companies, shall be fulfilled on their own account.

            The cleaning of all railways, which are at the balance of the Odessa Railways, shall be fulfilled by the means and on the account of Odessa Railways.

10.1.5. All the organizations, enterprises and establishments, located at the territory of the Odessa Commercial Sea Port or at the territory, alienated from the port, adjacent immediately to the territory of the port, shall participated in the cleaning of general use roads. The fixing of the area, which shall be cleaned, to one or another organization, is fulfilled by the order of the Captain of the port and shall be given to the corresponding organization.

 
10.2. On the preservation of the hydro-technical constructions

Measures for preventing the damages of the hydro-technical constructions

10.2.1. The vessel, which is moored to the berths, is not allowed to wind up the main engine at the distance, less than 15 m from the berth, excluding the cases, when such wind up is required to prevent the damage of the vessel or berth.

10.2.2. The vessels, which are moored at the berths of the port, are not allowed to work with the screw propeller. The exclusion is the diesel vessels, which are allowed to turn the screw propeller at the small turns, before the departure of the vessel.

10.2.3. All the damages, caused by the vessel to the port’s constructions, shall be compensated by the owners of the vessels (in presence of proofs, which confirm the fault of the vessel).

 10.3. On the measures for preventing the damage of submarine cables and turbo-wires, diving

 

10.3.1. The areas, in which the dropping of the anchor and dragging of different objects at the bottom are prohibited, are mentioned in the navigation maps.

10.3.2. The diving in the port can be fulfilled only under the permission of the Administration of the Captain of the port.

            The Master of the vessel of the requesting organization shall request the permission for the diving from the Administration of the Captain of the port, while the Master of the diving boat shall request such permission before starting the diving works from the Inspection of State Port Control (ISPC) and shall inform about the starting of the works to the ISPC and SRSN

 

 

 11. Sanitary and quarantine regime in the port.

 

11.1. The sanitary-quarantine examination of the coming and departing vessels is fulfilled twenty four hours per day.

            The masters of all vessels, coming from foreign ports, are obliged to inform the sanitary-quarantine department, through the agent company, about the sanitary-epidemic conditions of the vessel and about the presence of infectious patients and patients with temperature on the board of their vessels.

            If the Master has informed that the condition on the board of the vessel is not safe or about that there are ill people on the board of the vessel, the vessel should drop the anchor in one of the anchor places of the port (by the order of SRSN) and wait for further orders. In this case the pilot has no right to leave the vessel without the permission of the sanitary-quarantine service of the port.

11.2. The agent company shall inform the sanitary-quarantine department about the coming of the Ukrainian and foreign vessels in term not less than 12 hours before the time of coming of the vessel by the means of telephone message. If the journey of the vessel takes less than 48 hours, 6 hours prior the time of coming of the vessel. The abovementioned telephone message shall contain the following information:

  • Name of the vessel;
  • Flag of the vessel;
  • Port of registry of the vessel;
  • Number and health condition of the crew and passengers;
  • List of ports, where the vessel has stopped during the last 4 weeks;
  • Change of the crew during the last 4 weeks and port of change;
  • Presence and type of the system of disinfection of waste water;
  • General information about the cargo.

In the case of approach and stoppage of the vessel with fumigation cargo (grains, cotton cake, tapioca, etc.) on raid, the sanitary examination shall be fulfilled together with the physician- toxicologist, who shall establish the safety of the air of the work zone, where the members of the commission will work.

            11.3. After the vessel will come into the port, the Master of the vessel is obliged to present the following documents to the sanitary-quarantine service:

  • Marine sanitary declaration;
  • Report form (if required);
  • One copy of vessel’s function paper;
  • General and cargo declarations;
  • Information about the toxicological (radiological) safety of cargo;
  • Documents about the presence of equipment of disinfection and cleaning of waste water, which is acting in accordance with normative regime, or collecting tank;
  • Other documents, established by the International Conventions and Agreements.

            11.4. The 24th berth is assigned for the fulfillment of anti-epidemic measures and gas disinfestations of the vessels. This berth, during the fulfillment of measures, shall be free, provided by electricity, and has good entrance roads for the motor transport. In the cases when it is impossible to moor the vessel to the 24th berth, the quarantine berth will be regarded the berth where the vessel is located. The controlling of the vessel concerning the disembarkation of the crew members and embarkation of strangers is the responsibility of the Maritime Security Service of the State enterprise “Odessa Commercial Sea Port”. The territory of the abovementioned berth shall be lighted well during the night time and shall have the acting fire hydrant, as well as, reliable phone connection.

            The gas disinfestations of the vessel shall be fulfilled under the order of the sanitary-quarantine service. The request of its fulfillment shall be presented by the masters of the vessels to the department of preventive disinfection.

11.5. The masters of the vessels, which are passing the disinfestations, shall provide the protection and safety of the vessel, and they are responsible about installing the required signals on the vessels.

11.6. To solve the question about the treatment of the vessels, carrying provisions or toxic cargos, and to accept the special sanitary measures concerning these vessels, the agent company shall inform the sanitary-quarantine service of the Central Sanitary-Epidemic Station at the water transport about each case independently.

11.7. The port will not accept any sanitary dangerous cargos in the case of absence of conditions for its treatment. The acceptance and shipping of animals is prohibited.

11.8. The territory of the port and the roads should be poured by water. The Berths, where the treatment of the raw sugar was fulfilled, shall be cleaned thoroughly.

11.9. The cargos and materials, located in the storehouses of the port, which can be spoiled in accordance with the conclusion of the sanitary-epidemic station, shall be taken away from the port.

11.10. The general use lavatories shall correspond to the sanitary requirements, cleaned annually, cleaned by water and disinfected systematically.

11.11. The managers of the storehouses shall immediately inform the department of the preventive disinfection about all the cases of appearance of insects-pests. The load of the storehouses, infected by the pests, is prohibited until it will be disinfected.

11.12. The transportation of the provision outside the port is allowed only under the presence of permission of sanitary-epidemic station.

11.13. The doors of the administrative buildings and the storehouses, as well as, stairs, corridors and other places of general use shall be cleaned under the responsibility and on the account of the owners of such buildings.

11.14. The garbage boxes shall be cleaned and disinfected in-time. The territory around these garbage boxes shall not be filled with cargo to provide the free access to these garbage boxes.

11.15. The places for the port’s waste shall be established in special area with the modernized surface at the distance not less than 25 meters from the dinning rooms, cafeterias, production and auxiliary buildings.

11.16. Organizations or persons, responsible for the sanitary conditions of the establishments, store houses and other premises, are obliged to have the sanitary journals, which they should present by the request of the officers of the sanitary-epidemic station to write notes in it. The requirements of the sanitary service, written in the examination act, shall be fulfilled in full and during the time, mentioned in these acts.

11.17. All the organizations and persons, who are selling the foodstuffs at the territory of the port shall obey the sanitary requirements and rules concerning the clean status of the places, where they are selling the foodstuffs, concerning the medical examination of the personnel and concerning the examination of the conditions of the products, which they are selling.

11.18. To prevent the movement of the rodents from the shore to the vessel and from the vessel to shore, the entire mooring end should be protected by the shield, which diameter is not les than 720 mm, which should be installed on the mooring ends during the whole period of moor of the vessel at the berth. At the night, after finishing the cargo works, all the passenger and cargo ladders shall be removed or lifted for the distance not less than 1 meter and shall be lightened in a good manner.

11.19. The systems of biological cleaning on the vessels (where they are available) should be exploited in accordance with the instructions for this system. The responsibility for the quality of cleaning of plumbing waters is laid on the Master of the vessel during the mooring of the vessel at the berth or stopping at the raid, independent from that the waters were dropped or gathered on the vessel. The sanitary-quarantine service fulfills the laboratory control of the effectiveness of the cleaning. The quality of drainage system should be obligatory checked on the vessel.

            If there is an ill person on the board of the vessel, the drop and delivery of the non-disinfected waters to the collector is prohibited. The garbage from the vessels shall be obligatory disinfected.

11.20. During the execution of the permission for the vessel to leave the port, the Master shall present all the premises of the vessel for the examination, present all the medical certificates and certificates of examination of crew, 1 copy of the vessel’s role and references about the delivery of garbage and waste water to the port’s utilities. The permission for the vessel to leave the port is organized by the special stamp on the general declaration (vessel’s role) on the board of the vessel.

11.21. SQD's permit for departure of the vessel is valid during 24 hours from the moment of issue and must be submitted for registration to the ISPS.

Vessels of coastal navigation may receive the permit for a longer term (though not exceeding 1 month)/

11.22. If the cargo is fumigated with phosphine (by putting phosphine in the cargo), the vessel should leave the Port not later than 2 hours after fumigation began. The inspection commission starts its work immediately after loading fumigant in the cargo and hermetic sealing of holds.

11.23. The Port provides SQD with boats for making sanitary inspection of vessels staying in the roads, registering arrivals and implementing antiepidemiological measures on vessels.

11.24. Items: 5.6.4, 5.6.5, 5.6.6, 5.6.7, 5.6.8 of these CR are also referred to this section.

11.25. Control over fulfillment of sanitary and anti-epidemiological rules provided by these CR is exercised by the State Sanitary Control.

11.26. In the case of appearance of epidemic conditions in the world and the possibility to bring the infectious and quarantine diseases to Ukraine, the members of the state commission shall have the required means of individual protection with themselves. 

            The breach of these rules will entail the responsibility in accordance with the Law of Ukraine “On the securing of sanitary and epidemic protection of the people” No 4004-XII as of 24.02.1994 and “Sanitary rules for the commercial sea and river ports”

Annex № 1

Customs rules of the port

 

  1. CUSTOMS RULES FOR THE REGISTRATION OF THE ARRIVAL OF THE VESSEL TO THE PORT

1.1.Customs control of vessels arriving from abroad (going abroad) is executed, as a rule, at berth or, by way of exclusion, in the Port roads, as agreed with the Control Checkpoint of Border Forces of Ukraine (CCP).

1.2.The Master of the vessel or any other person from the crew of the vessel, dully authorized by the Captain, shall present the following documents for the fulfillment of Customs control:

  • General declaration;
  • Obligation concerning the taking out of the vessel under the foreign flag outside the Customs territory of Ukraine;
  • Cargo declaration;
  • Cargo documents, including the bills of lading, in which the name, marking, quantity or volume of the cargo or the quantity of places, which the cargo occupies shall be mentioned. In the case of necessity, this documents shall include information about the appearance, conditions and special characteristics of the goods;
  • List of crew members of the vessel (vessel’s role);
  • List of passengers;
  • Declaration about the personal effects of the crew members of the vessel;
  • Declaration about the vessel’s reserves;
  • Reference from the Master of the vessel about the presence of the narcotic (psychotropic) means, weapons and ammunition on the vessel;
  • Reference about the presence of foreign currency in the vessel’s cash desk;
  • Obligation of the Master of the vessel, which is sealing under the Ukrainian flag, that all the provisions, especially food, which was purchased abroad, will not be taken out outside the vessel;
  • Second copy of the obligation, executed during the arrival to the foreign port, about that the vessel, which is sealing under the flag of Ukraine, will be taken back into the Customs territory of Ukraine;
  • Documents, established by the Customs Code of Ukraine, other legislation acts concerning the Customs cases and by the International Agreements of Ukraine (if required).

The presented documents shall be signed by the Master of the vessel or by any other crew member, dully authorized by the Master, and confirmed by the seal of the vessel. In case of transportation of the goods in containers, the presentation of the bill of lading, signed by the head or any dully authorized employee of the agent organization (marine agent) and confirmed by the seal of this agent organization (marine agent), is permitted.

1.3.            The officer of the Customs authority, responsible for the registration of the documents, shall check its completeness, fulfills the verification of the information of the associated documents (i.e. information, mentioned in the cargo declaration and the information of the manifesto or bill of lading, etc.) and makes the correspondent marks in the checked documents.

1.4.            In the case of absence of any remarks, the officer of the Customs authority confirms the presented documents by his own numerical seal, excluding the bill of lading, manifesto, obligations of the Master of the vessel, which is sealing under the flag of Ukraine, reference about that the purchased abroad provisions, especially foods, will not be taken out outside the vessel and the obligation about the taking out of the vessel, which is sealing under the foreign flag, outside the Customs territory of Ukraine. On these documents the Customs officer shall put the stamp “under Customs control”.

The passenger vessels will be examined out-of-order

The agent of the vessels, which are sealing under the Ukrainian flag, shall inform the Customs about the time of arrival of those vessels 48 prior their arrival, while if the journey of the vessel is les than 48 hours, the agent shall inform the Customs 1 hour after the departure of the vessel from the port of departure. The agent of the foreign vessels shall inform the Customs about the time of arrival of those vessels after receiving the information from the Masters of those vessels. The agent companies shall inform the Customs about the adjusted time of arrival 4 hours prior to the arrival of the vessels to the port. The controller of the port informs the Customs by the means of fax about the planned place of mooring of the vessels to the berths of the port during the present 24 hours.

            The agents shall inform the Customs 4 hour prior to the departure of the vessels about the departure of the vessels.

            The agent organizations provide the delivery of the Customs officers to the board of the vessels with the aim to fulfill their duties. /the place of meeting of the commission, which will examine the vessel, is the Customs Administration.

  1. CUSTOMS CONTROL DURING VESSEL'S STAY IN PORT

2.1.            Port authorities inform customs of beginning and ending of cargo-handling operations on vessel.

2.2.            If it will be required to change the place of mooring of the vessel, the vessel’s agent shall inform the Customs about that.

2.3.            The loading and discharging of the cargos is carried out with the permit of the Customs under the Customs control.

The permission of the Customs authority for the taking out of the transport facilities and goods from the zone of Customs control and port is presented on the basis of the executed Customs declaration and other documents, established by the legislation, concerning the Customs cases, in the order, established by the Customs State Service of Ukraine. The presence of the transport facilities and goods, which has passed the Customs clearance, in the Customs control area, is prohibited, excluding the cases, when such presence is the result of functional and technical activity of the port or the Customs authority has received an information from other controlling authorities about the breach of the legislation during the Customs clearance of these transport facilities and goods.

2.4.            The Customs authority is fulfilling the accounting of the transport facilities and goods, which are discharged from the foreign-going vessel.

In the case of discovering of differences between the actual quantity of the transport facilities and goods and the data, mentioned in the cargo documents, or in the case of discovering of damaged, with the signs of damage of packages of goods, the informal-act is executed, which shall be signed by the representatives of the administration of the port and Customs authority, Master of the vessel and other persons, authorized by the transporter.

After the discharge of the foreign-going vessel, the quantity of the places and the volume of discharged goods are mentioned in the general act, which shall be signed by the by the representatives of the administration of the port, Customs authority and the vessel. One copy of this general act shall be kept in the files of the Customs authority.

2.5.            The loading of the goods on the vessel is fulfilled in accordance with the cargo lists and orders for loading after receiving the permission of the Customs.

2.6.            The administration of the port informs the Customs about the starting of the loading of the goods.

2.7.            The Masters of the foreign-going vessels has no right to accept any person on the board of the vessel after the ending of the Customs control without the permission of the Customs and Control Checkpoint of Border Forces of Ukraine (CCP).

2.8.            The loading to or discharging from the foreign-going vessels any goods after the ending of the Customs control is permitted only under the permission of the Customs and Control Checkpoint of Border Forces of Ukraine (CCP).

2.9.            All the floating facilities has no right to approach the foreign-going vessels, which are moored in the port or moving, without the permission of the Customs and Control Checkpoint of Border Forces of Ukraine (CCP).

 

  1. Customs rules for the registration of departure of vessels

3.1.3.1. The Master of the vessel or any other person from the crew of the vessel, dully authorized by the Captain, shall present the following documents for the fulfillment of Customs control:

  • General declaration;
  • Obligation concerning the taking out of the vessel under the foreign flag outside the Customs territory of Ukraine;
  • Cargo declaration;
  • Cargo documents, including the bills of lading, in which the name, marking, quantity or volume of the cargo or the quantity of places, which the cargo occupies shall be mentioned. In the case of necessity, this documents shall include information about the appearance, conditions and special characteristics of the goods;
  • List of crew members of the vessel (vessel’s role);
  • List of passengers;
  • Declaration about the personal effects of the crew members of the vessel;
  • Declaration about the vessel’s reserves;

3.3.In the case of absence of any remarks, the officer of the Customs authority confirms the presented documents by his own numerical seal, excluding the obligations of the Master of the vessel, which is sealing under the flag of Ukraine.

 

 

 Annex № 6

 Border rules for marine (river) passing points

 

The border control of the foreign and Ukrainian foreign-going vessels shall be fulfilled at the breath or, if required, at the raid. The border control of the passenger vessels, coming from abroad, in some cases, can be fulfilled at the travel line in the territorial waters of Ukraine, before the arrival (entrance) of the vessel to the port. In these cases, the commission should meet the vessel in the conditional place in the territorial sea of the internal waters of Ukraine.

The border control of the vessels is fulfilled in the order of their arrival during 24 hours. The agent companies shall inform the State Border Service about the arrival of the Ukrainian vessels 12 hours’ prior and foreign vessels 24 to their supposed arrival. The finalized time of arrival of the vessels should be presented not less than 2 hours prior to their arrival.

The agent companies should inform the State Border Service 2 hours before the beginning of registration of departure of the vessel to the foreign-going voyage.

The applications for the registration of the vessels shall be presented to the on duty department by the following phone number: 729-38-12.

The agent companies shall provide the delivery of the commission members to the vessel (and back) to fulfill their duties.

Before the start of border control of the foreign and Ukrainian vessels, departing abroad, all the strangers shall left the vessel, all the loading-discharging works shall be finished and all the crew members shall be on the board of the vessel.

During the border control of the foreign-going vessels and during the whole time of their mooring at the breath, the pass permit for the individual people to the board of the vessel is issued only under the permission of Head of the Border detached forces.

The place of stop of the foreign and Ukrainian non-military foreign-going vessels in the ports and at the raids until the moment of fulfillment of border control, embarkation and disembarkation of the passengers, as well as the loading and discharging of cargos, is established by the administration of the port under the agreement with the departments of the Border Service and Customs.

The foreign vessels are not allowed to change the place of their stop in the port or at the raid, to embark and disembark passengers, and to load and discharge cargos without the permission of the administration of the port and without the agreement with the department of the Border Service, excluding the emergency cases and accidents. The approach of the towboats, cranes, boats and other floating facilities to the foreign vessel is prohibited without the permission of the department of Border Service. The representatives of the companies, enterprises, organizations and port’s workers, who are servicing the foreign vessels, are allowed to go to the vessel by the pass permit, issued by the Odessa border detached forces, and identification card. The Dockers-mechanics are allowed to go to the foreign vessels only as members of the teams under the presence of order for work fulfillment of these vessels.

 The pass permits are issued by the Odessa border detached forces on the basis of written applications of the heads of the interested enterprises, organizations or establishments for the term up to one year. The one-time pass permits can be issued, if they will be required. The pass permit should be return after it will be expired.

Heads of shipping companies, ports, Customs, Captain of the ports and their deputies have the right to visit the foreign vessels, which are moored in the port, at any time of the day by presenting their service certificates.

The members of the commission, who fulfill the control of foreign and Ukrainian foreign-going vessels shall pass to the vessel with the senior officer of the border service and shall leave the vessel by the permission of this senior officer after finishing all their duties.

The crew members of the foreign vessels, who are foreign citizens, registered in the vessel’s role and have the actual certificate or seaman’s book, have the ability to go to the shore. The control of seamen, who are going to the port city and went back to the vessel, is fulfilled by the employees of Militarized Protection Service of the port at the entrance of the port on the basis of seaman’s book and vessel’s role.

The State Border Service of Ukraine prohibit the disembarkation of the crew members of the foreign vessels and other persons, who are on the board of the vessel, who has fulfilled the violation during the navigation and stay in the territorial waters (territorial sea) and internal waters of Ukraine, during the mooring of the vessels in the ports of Ukraine, as well as, for the persons, who is prohibited to enter Ukraine in accordance with the established order.

The crew members of the foreign vessels, who has fulfilled the act of hooliganism, provocation and other illegal actions against the officers of the State Border Service of Ukraine, will undergone the special measures, in accordance with the legislation of Ukraine, fulfilled by Head of the border detached forces   jointly with the authorities of Protection Service of Ukraine, Ministry of Internal Affairs, administration of the port and marine agencies.

The foreign citizens and citizens without citizenship, who has arrived to the port on the foreign vessels with the expired documents or without the documents of used form, which allow them to enter Ukraine, are not allowed to go to the shore. In some individual cases, the disembarkation of such persons can be allowed by the order of the Head of Odessa detached forces or his first deputy.

The head of the detached forces can allow the individual persons from the crew members of the foreign vessels, by the request of the Master of the vessel, to leave Ukraine by their seaman’s book or certificates on other vessels, leaving from the same port. The foreign seamen, who would like to leave Ukraine on the passing vessels, from other ports or by other type of transport, shall have the seaman’s book and vessel’s role. The agent companies shall inform about that in written form 1 day prior to the date of leave of those seamen. The same order is used for changing the crew of the foreign vessels, moored in the port or stopped at the raid.

The State Border Service of Ukraine coordinates the work of all authorities, who are controlling the fulfillment of established regime in the entrance point of the State Border of Ukraine.

The condition of the regime in the port and the Shift Service in the places  of mooring of foreign and Ukrainian foreign-going vessels is controlled by the authorized persons of the border service.

The Masters of the foreign-going vessels, and vessels under the state flag of Ukraine, are administratively responsible for the illegal stay of persons, who are not crew members or passengers, on the vessel. They should accept the required measures to prevent the entrance of strangers to the foreign-going vessels.

With the arrival of the vessel to the port, the Master shall accept the appropriate measures to prevent any person, who is staying on the board of the ship, to have any contact with the shore before receiving the corresponding permissions of the State Border Service of Ukraine, Customs and sanitary services.

The Master of the vessel shall establish the order of fulfilling the watch and general control of the vessel.

The watch at the vessels, staying at the raid, in the water area of the port or at the breaths, shall be organized 24 hours per day in accordance with the requirements of the instruction “On the measures, which prevent the entrance of strangers to the foreign-going vessels under the state flag of Ukraine in the ports of Ukraine and foreign ports”.

With the aim to prevent the entrance and departure of strangers on the vessels of Ukraine, the Master of the vessel is obliged to organize, by the power of the crew members, the thorough inspection of all premises of the vessel. By the order of the Master, each premise will be under the responsibility of a crew member, who will be responsible for the inspection of this premise of the vessel.

The inspection shall be obligatory fulfilled:

  • Before the departure from the Ukrainian port into the foreign-going trip and before arrival to the foreign port;
  • Before departure from each and last foreign port going to the Ukrainian port and before the arrival to the Ukrainian port.

The in-depth inspection of the vessel can be fulfilled by the order of the officer of the State Border Service of Ukraine.

The stay of the private floating facilities in the regime zone of the water area of the port is prohibited.

The departure (arrival) of the foreign and Ukrainian vessels to other Ukrainian ports of Ukraine is organized by the border service by the means of coasting trade or closing border. The agent organization shall inform the on-duty service of the department of border control about the departure of the ship in costing trade 2 hours prior to the time of departure of the vessel.

The legal and natural persons, who have violated the regime in the passing point through the state border of Ukraine, will bear the administrative responsibility in accordance with the legislation of Ukraine.

 

Annex № 7

 Securing the regime of marine safety in the port

             Within the fields of fulfillment of requirements of International Code on the protection of vessels and floating facilities, the constant acting system of the measures of marine safety is created and functioning in the port. This system includes the organization of the protection of the territory of the port and securing the passing regime, placement of the post of Marine Safety Service on the board of convention vessels and interaction of vessel’s safety officer with the Marine Safety Service post, PFSO and the officer of the Marine Safety Service; organization of the 24-hour control of vessels and port equipments by the means of power of the posts of Marine Safety Service and the technical means of video-control, attracting, if it will be required, the corresponding means and forces. The task of controlling of functionality of the mentioned system is laid on the Marine Safety Service of the port, which is controlling, too, the fulfillment of the requirements of requirements of International Code on the protection of vessels and floating facilities by the convention vessels, entering the port, and by the port’s EQUIPMENTS.

            Each convention vessel, which is intending to enter the port, shall, in advance, but not later than 3 days before the supposed time of arrival of the vessel to the port, inform the Marine Safety Service, through its agent or by itself, the following obligatory information concerning the fulfillment of the requirements of International Code on the protection of vessels and floating facilities:

1-     Presence of the international certificate of vessel safety, its form (temporary, constant), number, date of issue, name of the classification society, which has issued the certificate;

2-     Data about the approval of the vessel protection plan;

3-     Surname and position of the safety officer on the vessel and whether he has the corresponding certificate;

4-     Level of protection on the vessel during the entrance into the port;

5-     The level of protection, in which the vessel was exploited, in the last 10 ports (or during the last 90 days), which is longer, including: whether they have fulfilled the required protection procedures in the established manner;

6-     Data of the history of the vessel;

7-     Information about the ship owner;

8-     Other information, which is actually important, concerning the fulfillment of the requirements of International Code on the protection of vessels and floating facilities, excluding the details of the plan of vessel protection.

 

Documents, confirming and adding the abovementioned confirmation, shall be presented at the commission for registration of the arrival of the vessel to the vessel’s agent for its further presentation to the representative of the Marine Safety Service in the port.

 

 

            The late presentation of the abovementioned documents to the Marine Safety Service or the presentation of the improper documents can lead to that the vessel will not be allowed to enter the port. These can lead, too, to the execution of the whole complex of inspections by the Marine Safety Service concerning the fulfillment of the requirements of International Code on the protection of vessels and floating facilities.

 

            The vessel’s safety officer, after the arrival of the vessel to the port, shall establish a contact with the post of Marine Safety Service and the port’s officer, responsible for the protection.

SUMMARY
